REVIEW AND AMENDMENT OF THE BCDR PLAN. 7.1 The Contractor shall review part or all of the BCDR Plan (and the risk analysis on which it is based): (a) on a regular basis and as a minimum once every six Months; (b) within three Months of the BCDR Plan (or any part) having been invoked pursuant to paragraph 9 of this Schedule; (c) where the Authority requests any additional reviews (over and above those provided for in paragraphs 7.1.(a) and 7.1.(b) of this Schedule) by notifying the Contractor to such effect in writing, whereupon the Contractor shall conduct such reviews in accordance with the Authority's written requirements. The costs of both Parties for any such additional reviews will be met by the Authority; and (d) where the Authority requests an independent review of the Contractor‟s BCDR Plan or a Sub-contractor‟s BCDR Plan, the Contractor shall afford the Authority or the Authority‟s representatives such access to the Premises as may be required to review those records and processes as may be requested by the Authority in connection with the BCDR. 7.2 Each review pursuant to paragraph 7.1 of the BCDR Plan shall be a review of the procedures and methodologies set out in the BCDR Plan and shall assess their suitability having regard to any change to the Goods and/or Services or any underlying business processes and operations facilitated by or supported by the Goods and/or Services which have taken place since the later of the original approval of the BCDR Plan or the last review of the BCDR Plan and shall also have regard to any occurrence of any event since that date (or the likelihood of any such event taking place in the foreseeable future) which may increase the likelihood of the need to invoke the BCDR Plan. The review shall be completed by the Contractor within the period required by the BCDR Plan or if no such period is required within such period as the Authority shall reasonably require. The Contractor shall, within twenty Working Days of the conclusion of each such review of the BCDR Plan, provide to the Authority a report ("Review Report") setting out: (a) the findings of the review; (b) any changes in the risk profile associated with the Goods and/or Services; and (c) the Contractor's proposals ("Contractor's Proposals") for addressing any changes in the risk profile and its proposals for amendments to the BCDR Plan following the review detailing the impact (if any and to the extent that the Contractor can reasonably be expected to be aware of the same) that the implementation of such proposals may have on any services or systems provided by a third party. 7.3 The Contractor shall as soon as is reasonably practicable after receiving the Authority's approval of the Contractor's Proposals (having regard to the significance of any risks highlighted in the Review Report) effect any change in its practices or procedures necessary so as to give effect to the Contractor's Proposals. Following receipt of the Review Report and the Supplier’s Proposals, the Customer shall: review and comment on the Review Report and the Supplier’s Proposals as soon as reasonably practicable; and notify the Supplier in writing that it approves or rejects the Review Report and the Supplier’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Customer. If the Customer rejects the Review Report and/or the Supplier’s Proposals: the Customer shall inform the Supplier in writing of its reasons for its rejection; and the Supplier shall then revise the Review Report and/or the Supplier’s Proposals as the case may be (taking reasonable account of the Customer’s comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Supplier’s Proposals to the Customer for the Customer’s approval within twenty (20) Working Days of the date of the Customer’s notice of rejection. Prior to starting its review, the Service Provider shall provide an accurate written estimate of the total costs payable by the Purchaser for the Purchaser’s approval. Following receipt of the Review Report and the Service Provider’s Proposals, the Purchaser shall: review and comment on the Review Report and the Service Provider’s Proposals as soon as reasonably practicable; and notify the Service Provider in writing that it approves or rejects the Review Report and the Service Provider’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Purchaser. If the Purchaser rejects the Review Report and/or the Service Provider’s Proposals: the Purchaser shall inform the Service Provider in writing of its reasons for its rejection; and the Service Provider shall then revise the Review Report and/or the Service Provider’s Proposals as the case may be (taking reasonable account of the Purchaser's comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Service Provider’s Proposals to the Purchaser for the Purchaser's approval within twenty (20) Working Days of the date of the Purchaser's notice of rejection. Each review pursuant to paragraph 7.1 of the BCDR Plan pursuant to paragraph 114.1 of this Call off Schedule shall be a review of the procedures and methodologies set out in the BCDR Plan and shall assess their suitability having regard to any change to the Goods and/or Services or any underlying business processes and operations facilitated by or supported by the Goods and/or Services which have taken place since the later of the original approval of the BCDR Plan or the last review of the BCDR Plan and shall also have regard to any occurrence of any event since that date (or the likelihood of any such event taking place in the foreseeable future) which may increase the likelihood of the need to invoke the BCDR Plan. The review shall be completed by the Contractor Supplier within the period required by the BCDR Plan or or, if no such period is required required, within such period as the Authority Customer shall reasonably require. The Contractor Supplier shall, within twenty (20) Working Days of the conclusion of each such review of the BCDR Plan, provide to the Authority Customer a report ("a “Review Report"”) setting out:
(a) : the findings of the review;
(b) ; any changes in the risk profile associated with the provision of Goods and/or Services; and
(c) and the ContractorSupplier's proposals ("Contractorthe “Supplier's Proposals"”) for addressing any changes in the risk profile and its proposals for amendments to the BCDR Plan following the review detailing the impact (if any and to the extent that the Contractor Supplier can reasonably be expected to be aware of the same) that the implementation of such proposals may have on any goods, services or systems provided by a third party.
7.3 . Following receipt of the Review Report and the Supplier’s Proposals, the Customer shall: review and comment on the Review Report and the Supplier’s Proposals as soon as reasonably practicable; and notify the Supplier in writing that it approves or rejects the Review Report and the Supplier’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Customer. If the Customer rejects the Review Report and/or the Supplier’s Proposals: the Customer shall inform the Supplier in writing of its reasons for its rejection; and the Supplier shall then revise the Review Report and/or the Supplier’s Proposals as the case may be (taking reasonable account of the Customer’s comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Supplier’s Proposals to the Customer for the Customer’s approval within twenty (20) Working Days of the date of the Customer’s notice of rejection. The Contractor provisions of paragraphs 114.3 and 114.4 of this Call Off Schedule shall apply again to any resubmitted Review Report and Supplier’s Proposals, provided that either Party may refer any disputed matters for resolution by the Dispute Resolution Procedure at any time. The Contractor Supplier shall, within twenty (20) Working Days of the conclusion of each such review of the BCDR Plan, provide to the Authority Customer a report ("a “Review Report"”) setting out:
(a) : the findings of the review;
(b) ; any changes in the risk profile associated with the provision of Goods and/or Services; and
(c) and the ContractorSupplier's proposals ("Contractorthe “Supplier's Proposals"”) for addressing any changes in the risk profile and its proposals for amendments to the BCDR Plan following the review detailing the impact (if any and to the extent that the Contractor Supplier can reasonably be expected to be aware of the same) that the implementation of such proposals may have on any goods, services or systems provided by a third party.
7.3 . Following receipt of the Review Report and the Supplier’s Proposals, the Customer shall: review and comment on the Review Report and the Supplier’s Proposals as soon as reasonably practicable; and notify the Supplier in writing that it approves or rejects the Review Report and the Supplier’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Customer. If the Customer rejects the Review Report and/or the Supplier’s Proposals: the Customer shall inform the Supplier in writing of its reasons for its rejection; and the Supplier shall then revise the Review Report and/or the Supplier’s Proposals as the case may be (taking reasonable account of the Customer’s comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Supplier’s Proposals to the Customer for the Customer’s approval within twenty (20) Working Days of the date of the Customer’s notice of rejection. The Contractor provisions of paragraphs 7.17 and 7.18 of this Call Off Schedule 8 shall apply again to any resubmitted Review Report and Supplier’s Proposals, provided that either Party may refer any disputed matters for resolution by the Dispute Resolution Procedure at any time. Each review pursuant to paragraph 7.1 of the BCDR Plan pursuant to paragraph 99.1 of this Call off Schedule 8 shall be a review of the procedures and methodologies set out in the BCDR Plan and shall assess their suitability having regard to any change to the Goods and/or Services or any underlying business processes and operations facilitated by or supported by the Goods and/or Services which have taken place since the later of the original approval of the BCDR Plan or the last review of the BCDR Plan and shall also have regard to any occurrence of any event since that date (or the likelihood of any such event taking place in the foreseeable future) which may increase the likelihood of the need to invoke the BCDR Plan. The review shall be completed by the Contractor Supplier within the period required by the BCDR Plan or or, if no such period is required required, within such period as the Contracting Authority shall reasonably require. The Contractor Supplier shall, within twenty (20) Working Days of the conclusion of each such review of the BCDR Plan, provide to the Contracting Authority a report ("a “Review Report"”) setting out:
(a) : the findings of the review;
(b) ; any changes in the risk profile associated with the Goods and/or provision of Services; and
(c) and the Contractor's Supplier’s proposals ("Contractor's the “Supplier’s Proposals"”) for addressing any changes in the risk profile and its proposals for amendments to the BCDR Plan following the review detailing the impact (if any and to the extent that the Contractor Supplier can reasonably be expected to be aware of the same) that the implementation of such proposals may have on any services or systems provided by a third party.
7.3 . Following receipt of the Review Report and the Supplier’s Proposals, the Contracting Authority shall: review and comment on the Review Report and the Supplier’s Proposals as soon as reasonably practicable; and notify the Supplier in writing that it approves or rejects the Review Report and the Supplier’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Contracting Authority. If the Contracting Authority rejects the Review Report and/or the Supplier’s Proposals: the Contracting Authority shall inform the Supplier in writing of its reasons for its rejection; and the Supplier shall then revise the Review Report and/or the Supplier’s Proposals as the case may be (taking reasonable account of the Contracting Authority’s comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Supplier’s Proposals to the Contracting Authority for the Contracting Authority’s approval within twenty (20) Working Days of the date of the Contracting Authority’s notice of rejection. REVIEW AND AMENDMENT OF THE BCDR PLAN. 7.1 The Contractor Supplier shall provide a draft of the BCDR Plan within twenty (20) Working Days following the Commencement Date. The Supplier shall review part or all of the BCDR Plan (and the risk analysis on which it is based):
(a) ): on a regular basis and as a minimum once every six Months;
(b) calendar months; within three (3) Months of the BCDR Plan (or any part) having been invoked pursuant to paragraph 9 8 of this Schedule;
(c) schedule; and where the Authority Customer requests any additional reviews (over and above those provided for in paragraphs 7.1.(a) 6.2.1 and 7.1.(b) 6.2.2 of this Scheduleschedule) by notifying the Contractor Supplier to such effect in writing, whereupon the Contractor Supplier shall conduct such reviews in accordance with the AuthorityCustomer's written requirements. The costs of both Parties parties for any such additional reviews will be met by the Authority; and
(d) where the Authority requests an independent review of the Contractor‟s BCDR Plan or a Sub-contractor‟s BCDR Plan, the Contractor shall afford the Authority or the Authority‟s representatives such access to the Premises as may be required to review those records and processes as may be requested by the Authority in connection with the BCDR.
7.2 Customer. Each review pursuant to paragraph 7.1 6.1 of the BCDR Plan shall be a review of the procedures and methodologies set out in the BCDR Plan and shall assess their suitability having regard to any change to the Goods and/or Services or any underlying business processes and operations facilitated by or supported by the Goods and/or Services which have taken place since the later of the original approval of the BCDR Plan or the last review of the BCDR Plan and shall also have regard to any the occurrence of any event since that date (or the likelihood of any such event taking place in the foreseeable future) which may increase the likelihood of the need to invoke the BCDR Plan. The review shall be completed by the Contractor Supplier within the period required by the BCDR Plan or if no such period is required within such period as the Authority Customer shall reasonably require. The Contractor Supplier shall, within twenty (20) Working Days of the conclusion of each such review of the BCDR Plan, provide to the Authority Customer a report ("Review Report") setting out:
(a) : the findings of the review;

7.3 . The Contractor Supplier shall as soon as is reasonably practicable after receiving the AuthorityCustomer's approval of the ContractorSupplier's Proposals (having regard to the significance of any risks highlighted in the Review Report) effect any change in its practices or procedures necessary so as to give effect to the ContractorSupplier's Proposals. Any such change shall be at the Contractor‟s supplier's expense unless it can be reasonably shown that the changes are required because of a material change to the project‟s project’s risk profile.

(a) : the findings of the review;
(b) ; any changes in the risk profile associated with the Goods and/or provision of Services; and
(c) and the ContractorSupplier's proposals ("Contractorthe “Supplier's Proposals"”) for addressing any changes in the risk profile and its proposals for amendments to the BCDR Plan following the review detailing the impact (if any and to the extent that the Contractor Supplier can reasonably be expected to be aware of the same) that the implementation of such proposals may have on any goods, services or systems provided by a third party.
7.3 . Following receipt of the Review Report and the Supplier’s Proposals, the Customer shall: review and comment on the Review Report and the Supplier’s Proposals as soon as reasonably practicable; and notify the Supplier in writing that it approves or rejects the Review Report and the Supplier’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Customer. If the Customer rejects the Review Report and/or the Supplier’s Proposals: the Customer shall inform the Supplier in writing of its reasons for its rejection; and the Supplier shall then revise the Review Report and/or the Supplier’s Proposals as the case may be (taking reasonable account of the Customer’s comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Supplier’s Proposals to the Customer for the Customer’s approval within twenty (20) Working Days of the date of the Customer’s notice of rejection. The Contractor provisions of paragraphs 104.3 and 104.4 of this Call Off Schedule shall apply again to any resubmitted Review Report and Supplier’s Proposals, provided that either Party may refer any disputed matters for resolution by the Dispute Resolution Procedure at any time. Following receipt of the Review Report and the Supplier’s Proposals, the Contracting Authority shall: review and comment on the Review Report and the Supplier’s Proposals as soon as reasonably practicable; and notify the Supplier in writing that it approves or rejects the Review Report and the Supplier’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Contracting Authority. If the Contracting Authority rejects the Review Report and/or the Supplier’s Proposals: the Contracting Authority shall inform the Supplier in writing of its reasons for its rejection; and the Supplier shall then revise the Review Report and/or the Supplier’s Proposals as the case may be (taking reasonable account of the Contracting Authority’s comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Supplier’s Proposals to the Contracting Authority for the Contracting Authority’s approval within twenty (20) Working Days of the date of the Contracting Authority’s notice of rejection. The Contractor provisions of paragraphs 6.3 and 6.4 of this Call Off Schedule 8 shall apply again to any resubmitted Review Report and Supplier’s Proposals, provided that either Party may refer any disputed matters for resolution by the Dispute Resolution Procedure at any time. The CONTRACTOR shall test the BCDR Plan on a regular basis (and in any event not less than [*** once ***] in every [*** Year ***]). Subject to paragraph 14.2 of this Schedule, the CUSTOMER may require the CONTRACTOR to conduct additional tests of some or all aspects of the BCDR Plan at any time where the CUSTOMER considers it necessary, including where there has been any change to the Ordered IT Products or any underlying business processes, or on the occurrence of any event which may increase the likelihood of the need to implement the BCDR Plan. If the CUSTOMER requires an additional test of the BCDR Plan it shall give the CONTRACTOR written notice and the CONTRACTOR shall conduct the test in accordance with the CUSTOMER's requirements and the relevant provisions of the BCDR Plan. The CONTRACTOR's costs of the additional test shall be borne by the CUSTOMER unless the BCDR Plan fails the additional test in which case the CONTRACTOR's costs of that failed test shall be borne by the CONTRACTOR. Following each test, the CONTRACTOR shall send to the CUSTOMER a written report summarising the results of the test and shall promptly implement any actions or remedial measures which the CUSTOMER considers to be necessary as a result of those tests. The CONTRACTOR shall undertake and manage testing of the BCDR Plan in full consultation with the CUSTOMER and shall liaise with the CUSTOMER in respect of the planning, performance, and review, of each test, and shall comply with the reasonable requirements of the CUSTOMER in this regard. Each test shall be carried out under the supervision of the CUSTOMER or its nominee. The CONTRACTOR shall ensure that any use by it or any Sub-Contractor of "live" data in such testing is first approved with the CUSTOMER. Copies of live test data used in any such testing shall be (if so required by the CUSTOMER) destroyed or returned to the CUSTOMER on completion of the test. The CONTRACTOR shall, within twenty (20) Working Days of the conclusion of each test, provide to the CUSTOMER a report setting out: the outcome of the test; any failures in the BCDR Plan (including the BCDR Plan's procedures) revealed by the test; and the CONTRACTOR's proposals for remedying any such failures. Following each test, the CONTRACTOR shall take all measures requested by the CUSTOMER, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the CONTRACTOR, at no additional cost to the CUSTOMER, by the date reasonably required by the CUSTOMER and set out in such notice. For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s procedures) shall not relieve the CONTRACTOR of any of its obligations under this Schedule or otherwise. The CONTRACTOR shall also perform a test of the BCDR Plan as part of the commissioning of any new project.

The review shall be completed by the Contractor Supplier within the period required by the BCDR Plan or or, if no such period is required required, within such period as the Authority Customer shall reasonably require. The Contractor Supplier shall, within twenty (20) Working Days of the conclusion of each such review of the BCDR Plan, provide to the Authority Customer a report ("a “Review Report"”) setting out:
(a) : the findings of the review;
(b) ; any changes in the risk profile associated with the Goods and/or provision of Services; and
(c) and the ContractorSupplier's proposals ("Contractorthe “Supplier's Proposals"”) for addressing any changes in the risk profile and its proposals for amendments to the BCDR Plan following the review detailing the impact (if any and to the extent that the Contractor Supplier can reasonably be expected to be aware of the same) that the implementation of such proposals may have on any any, services or systems provided by a third party.
7.3 . Following receipt of the Review Report and the Supplier’s Proposals, the Customer shall: review and comment on the Review Report and the Supplier’s Proposals as soon as reasonably practicable; and notify the Supplier in writing that it approves or rejects the Review Report and the Supplier’s Proposals no later than twenty (20) Working Days after the date on which they are first delivered to the Customer. If the Customer rejects the Review Report and/or the Supplier’s Proposals: the Customer shall inform the Supplier in writing of its reasons for its rejection; and the Supplier shall then revise the Review Report and/or the Supplier’s Proposals as the case may be (taking reasonable account of the Customer’s comments and carrying out any necessary actions in connection with the revision) and shall re-submit a revised Review Report and/or revised Supplier’s Proposals to the Customer for the Customer’s approval within twenty (20) Working Days of the date of the Customer’s notice of rejection. The Contractor provisions of paragraphs 93.17 and 93.18 of this Call-Off Schedule shall apply again to any resubmitted Review Report and Supplier’s Proposals, provided that either Party may refer any disputed matters for resolution by the Dispute Resolution Procedure at any time. The Supplier shall as soon as is reasonably practicable after receiving the Authority's Customer’s approval of the ContractorSupplier's Proposals (having regard to the significance of any risks highlighted in the Review Report) effect any change in its practices or procedures necessary so as to give effect to the ContractorSupplier's Proposals. Any such change shall be at the Contractor‟s Supplier’s expense unless it can be reasonably shown that the changes are required because of a material change to the project‟s risk profileprofile of the Services.

REVIEW AND AMENDMENT OF THE BCDR PLAN. 7.1 The Contractor Supplier shall review part or all of the BCDR Plan (and the risk analysis on which it is based):
(a) ): on a regular basis and as a minimum once every six Months;
(b6) months; within three Months calendar months of the BCDR Plan (or any part) having been invoked pursuant to paragraph 9 of this Schedule;
(c) 7; and where the Authority Customer requests any additional reviews (over and above those provided for in paragraphs 7.1.(a) and 7.1.(b) 114.1.1and 114.1.2 of this Schedule) Call Off Schedule 8) by notifying the Contractor Supplier to such effect in writing, whereupon the Contractor Supplier shall conduct such reviews in accordance with the Authority's Customer’s written requirements. Prior to starting its review, the Supplier shall provide an accurate written estimate of the total costs payable by the Customer for the Customer’s approval. The costs of both Parties for of any such additional reviews will shall be met by the Authority; and
(d) where Customer except that the Authority requests an independent review of Supplier shall not be entitled to charge the Contractor‟s BCDR Plan or a Sub-contractor‟s BCDR Plan, Customer for any costs that it may incur above any estimate without the Contractor shall afford the Authority or the Authority‟s representatives such access to the Premises as may be required to review those records and processes as may be requested by the Authority in connection with the BCDR.
7.2 Customer’s prior written approval. Each review pursuant to paragraph 7.1 of the BCDR Plan pursuant to paragraph 114.1 of this Call off Schedule 8 shall be a review of the procedures and methodologies set out in the BCDR Plan and shall assess their suitability having regard to any change to the Goods Products and/or Services or any underlying business processes and operations facilitated by or supported by the Goods and/or Services which have taken place since the later of the original approval of the BCDR Plan or the last review of the BCDR Plan and shall also have regard to any occurrence of any event since that date (or the likelihood of any such event taking place in the foreseeable future) which may increase the likelihood of the need to invoke the BCDR Plan.
