Common use of Right and Obligation to Take in Kind Clause in Contracts

Right and Obligation to Take in Kind. Except as otherwise provided in this Article IX or in Article VIII, each Party shall have the right and obligation to own, take in kind and separately dispose of the share of total production available to it from any Exploitation Area pursuant to the Contract and this Agreement in such quantities and in accordance with such procedures as may be set forth in the offtake agreement referred to in Article 9.2 or in the special arrangements for natural gas referred to in Article 9.3. If GNPC is party to the offtake agreement, then the Parties shall endeavor to obtain its agreement to the principles set forth in this Article IX.

If GNPC Government Oil Company is party to the offtake agreement, then the Parties shall endeavor endeavour to obtain its agreement to the principles set forth in this Article IXArticle.
