Common use of Right of Access, Equipment Installation, Removal Clause in Contracts

Right of Access, Equipment Installation, Removal. Inspection. DEC may send employees, agents or contractors to Member’s premises at any time, whether before, during or after the time the Facilities first produce energy to inspect the Facilities and Interconnection Facilities. DEC may monitor and observe the Facility’s installation, commissioning (including any testing), startup, operation, and maintenance. DEC shall at all times have direct, unabated access to the disconnect switch and metering equipment of the Facility. DEC shall provide reasonable notice to Member when possible prior to exercising its right of access.
