Common use of Right of Repayment Clause in Contracts

Right of Repayment. Destination NSW may, upon 28 days’ written notice, require the Partner to repay the whole, or any part, of the Funding together with any interest earned thereon to Destination NSW if, in the reasonable opinion of Destination NSW, the Partner has failed to meet the Performance Obligations in whole or in part, having regard to the nature and extent of the Partner’s non-compliance and the extent to which the economic benefits of the Program as contemplated by Destination NSW in entering into this Agreement have been achieved.
