Common use of Right of the Owner Clause in Contracts

Right of the Owner. Upon the occurrence and continuance of an Event of Default described in Section 6.1, the Owner may, at its option, terminate this Agreement, in accordance with Section 5.3, by delivering written Notice of termination to the Operator, which Notice of termination shall be effective immediately. In such event, Operator shall take all necessary steps to protect the Facility, leaving the same in an orderly and safe condition, prior to leaving the premises. The rights and remedies of the Owner (and of any Person acting on behalf of or claiming through the Owner) under this Section 6.2(b) shall be the Owner's (and any such Person's) sole right and remedy for any breach of or default under the terms of this Agreement.
