RIGHT, TITLE AND INTEREST IN THE FACILITY. 3.3.1 The Parties acknowledge that full ownership, rights and title to the Facility (including any additions, modifications or construction thereon carried out by the Operator pursuant to this Agreement) shall be vested with the Authority throughout the Services Period and thereafter and the Operator shall not create any encumbrance or other third- party rights over the Facility or any part thereof or otherwise sub-let or part with the possession of the Facility at any time during the Services Period.
