Right to Immediate Payment or Performance. 5.2.1 Tarion shall not be bound to make any demand on or to seek or exhaust its recourse against the Builder or any other person or to realize on any Security or assurances held by Tarion in respect of the Indemnified Amounts before being entitled to demand payment from or performance by the Builder and enforce its rights under this Agreement and the Builder hereby renounces all benefits of discussion and division.
