Common use of Right to Rely on this Contract Clause in Contracts

Right to Rely on this Contract. You promise that all the information you provided to us in Part 1 of this contract is complete and true, and that Part 1 has been completed according to your instructions, as confirmed by your signature(s) on Part 1 of this contract and/or through the use of your account. You acknowledge the receipt of and agree to the terms, responsibilities and liabilities of this contract (given to you in person and/or e-mailed to you at the address in Part 1 if provided), which specifically includes this agreement and the accompanying Expedited Funds Availability disclosures, Electronic Fund Transfer disclosures, Privacy Policy, our Rate and Fee disclosures (that follow this agreement), our bylaws, and to any changes that we make from time to time. You understand that we may optically scan, image, or film your original Part 1, and agree that imaged or filmed Part 1 is binding on you and us as Part 1 of this contract. You further understand that you may request additional copies of this contract (Parts 1 and 2 (which specifically includes this agreement and disclosures)) that comprise your and our contract from us at any time. You may also download Part 2 (the agreement and disclosures) from our web site. Furthermore, you agree and understand that you may change, close or terminate your accounts, services or membership with us at any time according to terms of this contract. For all transactions on the account, and for any changes to, distributions from, or closure or termination of the account or services, you authorize us to rely exclusively on the terms of Parts 1 and 2 of this contract, our bylaws, bylaw amendments and any changes we make from time to time to the agreement, disclosures, bylaws and policies. You agree that we have no obligation to rely on any other documents unless otherwise required. Furthermore, you agree that any additional accounts or services that you request will also be governed by Parts 1 and 2 of this contact, our bylaws and policies, and any changes we make to them from time to time. Please note that the headings of this agreement are for quick reference purposes only and are not part of this contract.

You understand To reduce costs for all members, you agree that we may optically scan, image, film or film electronically capture (as technology allows) the image of your original Part 11 and revised Part 1s as applicable (and all related forms and doc- uments that pertain to your account(s) and services), and agree that imaged or filmed the electronic copy of Part 1 is (and all related forms and documents are) binding on you and us as us. You may request a copy of your Part 1 of this contract1(s) (or other form we use) and any related form(s) and document(s) anytime we are open for business. You further understand that you may request additional copies of this contract (Parts 1 and 2 (which specifically includes this agreement and disclosures)) that comprise your and our contract from us at any time. You may also download Part 2 (the agreement and disclosures) from our web site. Furthermoreinitiate, you agree and understand that you may change, add, close or terminate your accounts, services or membership with us at any time according ac- cording to terms of this contractContract. Please note Upon your request, when we allow you to open an account with- out completing a Part 1 account form (or other form that we use), you agree that the headings ownership and/or survivorship features of the account are governed by the ownership and/or survivorship fea- tures that we have input into our data processing system for the account according to your instructions (see Provision 4,. regard- ing account ownership and survivorship features), and which can displayed in a print out of the ownership and survivorship features for the account from our data processing system. You understand that you may reconfirm, and/or obtain a Part 1 account form that substantiates, the ownership and/or survivorship features of the account by contacting us anytime we are open for business. Finally, for your convenience and upon request, if you open, initi- ate, change, add or close an account or service by phone or in person (or if we allow, online), you understand and agree that the appearance (or removal) of that account on your periodic state- ment confirms your request for (or removal of) that account and/or service, that you have verified whether the account and/or service was opened, initiated, changed, added, closed or terminated cor- rectly, and that the account and/or service is governed by Parts 1 and 2 of this agreement Contract, our Bylaws and policies, and any changes we make to them from time to time. You understand that you may reconfirm and obtain a Part 1 account form or a revised Part 1 account form (or other form we use) that indicates that you have opened, initiated, changed, added, closed or terminated an ac- count and/or service by phone (or if we allow, online) by contact- ing us anytime we are open for quick reference purposes only and are not part of this contractbusiness.
