Rights and obligations upon merger. In the event of such a merger or conversion the other Agents, the Note Trustee, the Security Trustee (if applicable) and such successor shall acquire and become subject to the same rights and obligations between themselves as if they had entered into an agreement in the form of and on the same terms as this Agreement and all references in this Agreement to the applicable agent shall be deemed to be references to such successor.
