Common use of Rights as Lenders Clause in Contracts

Rights as Lenders. With respect to its commitment to make Loans, Bank of America, N.A. shall have the same rights and powers hereunder as any Lender and may exercise the same as though it was not acting as the Administrative Agent and the term "Lender" or "Lenders" shall, unless the context otherwise indicates, include Bank of America, N.A. in its individual capacity. Bank of America, N.A. and its Affiliates may (without having to account therefor to any Lender) accept deposits from, extend credit (on a secured or unsecured basis) to and generally engage in any kind of banking, trust or other business with the Borrower or any of its Affiliates, as if it were not acting as the Administrative Agent.
