Common use of Rights of Agent Not to Be Impaired Clause in Contracts

Rights of Agent Not to Be Impaired. No right of Agent or any other member of the Lender Group to enforce the subordination provided for herein or to exercise its other rights hereunder shall at any time in any way be prejudiced or impaired by any act or failure to act by any Obligor, Agent or any other member of the Lender Group hereunder or under or in connection with the other Loan Documents or by any noncompliance by the other Obligors with the terms and provisions and covenants herein or in any other Loan Document, regardless of any knowledge thereof Agent or any other member of the Lender Group may have or otherwise be charged with.

Rights of Agent Not to Be Impaired. No right of Agent or any other member of the Lender Noteholder Group to enforce the subordination provided for herein or to exercise its other rights hereunder shall at any time in any way be prejudiced or impaired by any act or failure to act by any Obligor, Agent or any other member of the Lender Noteholder Group hereunder or under or in connection with the other Loan Indenture or the Security Documents or by any noncompliance by the other Obligors with the terms and provisions and covenants herein or in the Indenture or any other Loan Security Document, regardless of any knowledge thereof Agent or any other member of the Lender Noteholder Group may have or otherwise be charged with.
