Common use of Rights of Members in Capital Clause in Contracts

Rights of Members in Capital. No Member shall have the right to distributions or the return of any contribution to the capital of the Company except (i) upon the redemption by the Company of some or all of such Member’s Units pursuant to Section 5.4 or (ii) upon the dissolution of the Company pursuant to Section 6.2. The entitlements to any such return at such time shall be limited to the Net Asset Value of the Units held by such Member. No Member shall be entitled to interest on such Member's contributions to the capital of the Company.

Rights of Members in Capital. No Member shall be entitled to interest on such Member's ’s contributions to the capital of the Company.

(b) No Member shall have the right to distributions or the return of any contribution to the capital of the Company except (i) upon the redemption by the Company of some or all withdrawal of such Member’s Units Member pursuant to Section 5.4 Article 5.5 or (ii) upon the dissolution of the Company pursuant to Section 6.2Article 6. 1. The entitlements entitlement to any such distribution or return at such time shall be limited to the Net Asset Value value of the Units held by such Capital Account of the Member. No Member The Manager shall not be entitled to interest on liable for the distribution or return of any such Member's contributions to the capital of the Companyamounts.

(b) No Member shall have the right to distributions or the return of any capital contribution to the capital of the Company except (i) upon the redemption by the Company of some or all withdrawal of such Member’s Units Member pursuant to Section 5.4 5.3 or (ii) upon the dissolution of the Company pursuant to Section 6.26.1. The entitlements to Company shall be responsible for the return of any such return at such time shall be limited to the Net Asset Value of the Units held by such Member. No Member shall be entitled to interest on such Member's contributions to the capital of the Companyamounts in accordance with this Agreement.

Rights of Members in Capital. (a) No Member shall be entitled to interest on any Company Capital Contributions. (b) No Member shall have the right to distributions or the return of any contribution to the capital portion of the its Company Capital Contributions or Capital Account balance except (i) upon the redemption by the Company of some or all of such Member’s Units pursuant to Section 5.4 or for distributions in accordance with Article VII and (ii) upon the dissolution of the Company pursuant to Section 6.2in accordance with Article XI. The entitlements entitlement to any such return at such time shall be limited to the Net Asset Value of the Units held by such Member. No amount specifically set forth in this Agreement and no Member shall be entitled to interest any payment on such Member's contributions to the capital account of goodwill of the Company.
