Common use of Rights of Senior Lender Not to Be Impaired Clause in Contracts

Rights of Senior Lender Not to Be Impaired. No right of Senior Lender to enforce the subordination provided for herein or to exercise its other rights hereunder shall at any time in any way be prejudiced or impaired by any act or failure to act by the Borrower or Senior Lender hereunder or under or in connection with the Senior Lender Loan Documents or by any noncompliance by the Borrower with the terms and provisions and covenants herein or in any other Loan Document, regardless of any knowledge thereof Senior Lender may have or otherwise be charged with.

Rights of Senior Lender Not to Be Impaired. No right of the Senior Lender to enforce the subordination as provided for herein or to exercise its other rights hereunder in this Section 7 shall at any time in any way be prejudiced or impaired by any act or failure to act by on the Borrower part of the Maker or Senior Lender hereunder anyone in custody of its assets or under or in connection with the Senior Lender Loan Documents property or by any noncompliance non-compliance by the Borrower Maker with the terms and terms, provisions and or covenants herein or in any other Loan Documentof this Note, regardless of any knowledge thereof which the Senior Lender may have or otherwise be charged with.

Rights of Senior Lender Not to Be Impaired. No right of Senior Lender to enforce the subordination as herein provided for herein or to exercise its other rights hereunder shall at any time in any way be prejudiced or impaired by any act or failure to act in good faith by the Borrower or Senior Lender hereunder or under or in connection with the Senior Lender Loan Documents Lenders, or by any noncompliance by the Borrower Guarantor or Borrower, with the terms and terms, provisions and covenants herein or in any other Loan Documentherein, regardless of any knowledge thereof Senior Lender or the Lenders may have or otherwise be charged with. The provisions of this Article III are intended to be for the benefit of the Senior Lender and the Lenders, and shall be enforceable directly by Senior Lender.
