Common use of Rights of Trustees, Employees, Independent Contractors Clause in Contracts

Rights of Trustees, Employees, Independent Contractors. and Agents To Own Units or Other Property and To Engage in Other Business. Any Trustee, member of the Special Committee, employee, independent contractor or agent of the Trust may acquire, own and hold Units for his individual account and may exercise all rights therein, thereof and thereunder to the same extent and in the same manner as if he were not such a Trustee, employee, independent contractor or agent. Any such Trustee, member of the Special Committee, employee, independent contractor or agent may, in his personal capacity or in a capacity of trustee, officer, director, stockholder, partner, member, employee or agent of any Person or otherwise, have business interests and holdings similar to or in addition to those relating to the Trust. Subject to the provisions of Article V, any Trustee, member of the Special Committee, employee, independent contractor or agent of the Trust may be a trustee, officer, director, stockholder, partner, member, employee, agent or independent contractor of, or otherwise have a direct or indirect interest in, any Person which may be engaged to render advice or services to the Trust, and may receive compensation from such Person as well as compensation as Trustee, employee, independent contractor or agent or otherwise hereunder. None of these activities shall be deemed to conflict with his duties as Trustee, member of the Special Committee, employee, independent contractor or agent.

Subject to the provisions of Article VV hereof, any Trustee, member of the Special Committee, employee, independent contractor or agent of the Trust may be a trustee, officer, director, stockholdershareholder, partner, member, employeeadvisor, agent employee or independent contractor of, or otherwise have a direct or indirect interest in, any Person which who may be engaged to render advice or services to the Trust, and may receive compensation from such Person as well as compensation as Trustee, employee, independent contractor or agent or otherwise hereunder. None of these activities shall be deemed to conflict with his duties as Trustee, member of the Special Committee, employee, independent contractor or agent.
