Common use of Rights of Unit Holders Clause in Contracts

Rights of Unit Holders. The registered owner of a Unit Certificate shall have all the rights and privileges of a registered owner of the Senior Preferred Stock of Holdings represented thereby and the number of shares of Class B Common of Holdings represented thereby and shall be treated as the registered owner thereof for all purposes.

The Company agrees that it shall be bound by all provisions of the Indenture governing the Debentures, the Debentures, the Warrant Agreement and the Warrants and that the Debentures and Warrants represented by each Unit Certificate shall be deemed valid and obligatory obligations of the Company.
