Common use of Rights Prior to Exercise of Option Clause in Contracts

Rights Prior to Exercise of Option. This option may be transferable by Optionee, upon the mutual agreement of the parties except in the event of Optionee's death as provided in paragraph 4(b) above, whereby Optionee's executors or administrators may transfer the option upon mutual agreement of the parties. Optionee shall have no rights as a stockholder with respect to the option shares until payment of the option price and delivery to him of such shares as herein provided.
