Rights Several. The rights of the Company, the Adviser and each Shareholder under this Deed shall be in all respects several and the failure of any one or more of them to perform obligations under any agreement shall in no way affect the rights of the others of them under or in connection with this Deed. It shall not be necessary for the Company, the Adviser or any other Shareholder to be joined as an additional party in any proceedings by a Shareholder to protect or enforce its rights and interests under this Deed.
