Rights to Take Fresh Water at the Take Points. Subject to Section 2.2, Service Provider is responsible for obtaining all necessary rights, including all Governmental Approvals, to take Fresh Water from the Take Points in sufficient volumes to make available Frac Water at the Frac Water Delivery Points at the required rates of flow. Producer will provide all information to Service Provider that is required for Service Provider to acquire, and will use commercially reasonable efforts to assist Service Provider in acquiring, such rights.
