Common use of RISK OF DAMAGE AND LOSS Clause in Contracts

RISK OF DAMAGE AND LOSS. The Customer shall bear the risk of any damage to or loss of the rented products during the entire term as well as during transit from and to DOKA. If the rented products are lost or considerably damaged, DOKA shall be entitled to demand compensation for the amount of the then Current List Price of such products. Furthermore, in the event that such products are damaged, DOKA has the option of demanding either compensation for the costs of repair or for the loss in value of such products in the amount of the then Current List Price.
