Role of the Calculation Agent. The Calculation Agent has the sole discretion to make all determinations regarding this Note, including determinations regarding the Basket Return, the Basket Level, the Basket Percentage Change, the Supplemental Redemption Amount, Market Disruption Events, Successor Indices, business days, and trading days. Absent manifest error, all determinations of the Calculation Agent will be final and binding on the holder of this Note and the Corporation, without any liability on the part of the Calculation Agent. The Corporation has initially appointed its affiliate, Banc of America Securities LLC, as the Calculation Agent, but the Corporation may change the Calculation Agent at any time without notifying the holder of this Note.
