Common use of ROW and Environmental Status of the Project Clause in Contracts

ROW and Environmental Status of the Project. All proposed improvements for the Project are anticipated to be constructed/installed within existing ADOT freeway ROW. The Project environmental process has yet to be conducted, however, ADOT anticipates that the Work will be eligible for a categorical exclusion (“CE”) determination. Investigations are continuing and further details will be provided in the RFP. It is important to note that, at this time, the Project remains in the environmental process. Final environmental approvals and related requirements have not yet been secured. A no-build alternative is always considered in the environmental process, and it is possible that the Project scope (including the scope of any one section) may need to be modified to comply with the environmental process, or that a no-build alternative may be adopted. Nothing contained in this RFQ, including any description of the Project, is intended to modify, limit, or otherwise constrain the environmental process or commit ADOT or any other entity to undertake any action with respect to the Project, including any procurement for the final design and construction/installation of the Project.
