Common use of Royalty Gas Clause in Contracts

Royalty Gas. The Parties acknowledge that, in case the Government of Madhya Pradesh takes in kind Gas in lieu of the royalty payments due from Seller to it under the CBM Contract, then Seller may by prior notice: (i) reduce Buyer’s DCQ on a pro rata basis (or such other basis as may be required under Law) with all purchasers of Gas produced under the CBM Contract; and/or (ii) reduce the term of this Agreement, such reductions to take effect on the Day notified by Seller in writing or such other date as may be required under Law.
