Common use of RSA Effective Date Clause in Contracts

RSA Effective Date. This Agreement shall become effective, and the obligations contained herein shall become binding upon the Parties, upon the first date (such date, the “RSA Effective Date”) that this Agreement has been executed by all of the following: (a) each Debtor; (b) Consenting Bridge Financing Lenders (i) holding, in excess of 90% in principal amount outstanding of all claims against the Debtors arising on account of the Bridge Financing Facility

RSA Effective Date. This Agreement shall become effective, and the obligations contained herein shall become binding upon the Parties, upon the first date (such date, the “RSA Effective Date”) that this Agreement has been executed by all of the following: (ai) each Debtor; 3 The Plan shall be filed in accordance with the Milestones (bas defined below) Consenting Bridge Financing Lenders (i) holding, set forth in excess Section 6 of 90% this Agreement. 4 The Disclosure Statement shall be filed in principal amount outstanding accordance with the Milestones set forth in Section 6 of all claims against the Debtors arising on account of the Bridge Financing Facilitythis Agreement.

This Agreement shall become effective, and the obligations contained herein shall become binding upon the Parties, upon the first date (such date, the “RSA Effective Date”) that this Agreement has been executed and delivered by all of the following: (a) each DebtorChaparral Party; (b) and Consenting Bridge Financing Lenders (i) Noteholders holding, in excess of 90% the aggregate, at least [60]% in principal amount outstanding of all claims against the Debtors arising on account of the Bridge Financing FacilityNotes Claims.

RSA Effective Date. This Agreement shall become effective, and the obligations contained herein shall become binding upon the Parties, upon the first date (such date, the “RSA Effective Date”) that this Agreement has been executed by all of the following: (a) each Debtor; and (bc) Consenting Bridge Financing Lenders (i) Restructuring Support Parties holding, in excess of 90aggregate, at least 63.0% in principal amount outstanding of all claims against the Debtors arising on account of the Bridge Financing FacilitySecond Lien Indenture (the “Second Lien Notes Claims”).
