Common use of Safeguards Clause in Contracts

Safeguards. Business Associate agrees to maintain appropriate safeguards to ensure that PHI is not used or disclosed other than as provided by this Agreement or as required by law. Business Associate shall comply with Subpart C of 45 CFR Part 164 of HIPAA. Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI it creates, receives, maintains, or transmits on behalf of Covered Entity.

Safeguards. Business Associate agrees to maintain appropriate safeguards to ensure that PHI is not used or disclosed other than as provided by this Agreement or as required by law. Business Associate shall use appropriate safeguards and comply with Subpart C of 45 CFR Part C.F.R. 164 with respect to electronic PHI to prevent use or disclosure of HIPAAthe PHI other than as provided for by this Agreement. Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any paper or electronic PHI it creates, receives, maintains, or transmits on behalf of Covered Entity.

Safeguards. 2.1 Business Associate agrees to maintain shall use appropriate safeguards to ensure that prevent the use or disclosure of PHI is not used or disclosed other than as provided for by this Agreement or as required by law. Safeguards. The Business Associate agrees to maintain implement and use appropriate safeguards Security, Administrative, Physical and Technical Safeguards, and comply where applicable with subpart C of 45 C.F.R. Part 164, to ensure that prevent use or disclosure of PHI is not used or disclosed other than as required by law or as provided for by this Agreement or as required by lawthe Related Agreement. Business Associate shall comply with Subpart C identify in writing upon request from the Department all of 45 CFR Part 164 those Safeguards that it uses to prevent impermissible uses or disclosures of HIPAA. Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI it creates, receives, maintains, or transmits on behalf of Covered EntityPHI.

Safeguards. Business Associate agrees to shall maintain appropriate safeguards to ensure that PHI is not used or disclosed other than as provided by this Agreement BAA or as required by law. Business Associate shall comply , in accordance with Subpart C of 45 CFR Part 164 of HIPAA164. Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI it creates, receives, maintains, or transmits on behalf of Covered Entity.

Safeguards. Business Associate agrees to maintain use reasonable and appropriate administrative, physical and technological safeguards to ensure that prevent use or disclosure of the PHI is not used or disclosed other than as provided for by this Agreement or as required by lawAgreement. In addition, Business Associate shall implement such safeguards and security measures as are necessary to comply with Subpart the HIPAA Security Rule as set forth in 45 CFR Parts 160 and Subparts A and C of 45 CFR Part 164 of HIPAA164. The Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect will report to the confidentiality, integrity, and availability Covered Entity within twenty-four (24) hours of discovery any electronic PHI it creates, receives, maintains, or transmits on behalf security incident of Covered Entitywhich the Business Associate is aware.

Safeguards. Business Associate agrees to shall maintain and use appropriate and commercially reasonable safeguards to ensure that prevent use and/or disclosure of PHI is not used or disclosed other than as provided by permitted or required in this Agreement or as required by lawAgreement. Business Associate shall also comply with Subpart C the applicable provisions of 45 CFR Part 164 of HIPAA. Business Associate shall implementthe Security Rule, and shall contractually require that Agent and other subcontractors including the requirement to implement administrative, physical physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI it createsthe Electronic PHI, receivesas required by the HIPAA Rules, maintains, or transmits on behalf specifically Subpart C of Covered Entity45 CFR Part 164.

Safeguards. Business Associate agrees to agrees, represents and warrants that it shall maintain appropriate technical, physical, and administrative safeguards to ensure that prevent the unauthorized use or disclosure of PHI is not used or disclosed other than as provided by in violation of this Business Associate Agreement or as required by lawthe HIPAA Regulations. Business Associate shall comply with Subpart C of 45 CFR Part 164 of HIPAA. Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI it that Business Associate creates, receives, maintains, or transmits in electronic media in connection with Services for or on behalf of Covered Entity.

Safeguards. Business Associate agrees to maintain use appropriate safeguards safeguards, consistent with applicable law, to ensure that prevent the access, use or disclosure of PHI is not used or disclosed other than otherthan as provided for by this Agreement or as required by lawAgreement. To the extent that Business Associate shall comply with Subpart C of 45 CFR Part 164 of HIPAA. creates, receives, maintains or transmits Electronic PHI, Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement agrees to use appropriate administrative, physical and technical safeguards that reasonably and appropriately to protect the confidentiality, integrity, integrity and availability of any electronic PHI it creates, receives, maintains, or transmits on behalf of Covered Entity’s Electronic PHI in accordance with the HIPAA Regulations.

Safeguards. The Business Associate agrees to maintain implement and use appropriate safeguards Security, Administrative, Physical and Technical Safeguards, and comply where applicable with subpart C of 45 C.F.R. Part 164, to ensure that prevent use or disclosure of PHI is not used or disclosed other than as required by law or as provided for by this Agreement BAA or as required by lawPSC 00-000-0000-0000. Business Associate shall comply with Subpart C identify in writing upon request from the Department all of 45 CFR Part 164 those Safeguards that it uses to prevent impermissible uses or disclosures of HIPAA. Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI it creates, receives, maintains, or transmits on behalf of Covered EntityPHI.

Safeguards. Business Associate agrees shall employ appropriate administrative, technical and physical safeguards, consistent with the size and complexity of Business Associate’s operations, to maintain appropriate safeguards protect the confidentiality of PHI and to ensure that prevent the use or disclosure of PHI is not used or disclosed other than as provided by in any manner inconsistent with the terms of this Agreement or as required by lawAgreement. Business Associate shall comply comply, where applicable, with Subpart C of 45 CFR C.F.R. Part 164 of HIPAA. Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any with respect to electronic PHI it creates, receives, maintains, to prevent use or transmits on behalf disclosure of Covered Entitysuch electronic PHI other than as provided for by this Agreement.

Business Associate shall implement, and shall contractually require that Agent and other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI (“ePHI”) it creates, receives, maintains, or transmits on behalf of Covered Entity.

Safeguards. Business Associate agrees to maintain implement appropriate administrative, physical and technical safeguards to ensure that PHI is not used or disclosed other than as provided by this Agreement or as required by lawprotect the confidentiality, integrity and availability of all PHI. Business Associate shall comply agrees to implement appropriate electronic security practices for PRACTICE NAME PHI, which is transmitted, stored, received, or used in electronic form, in compliance with Subpart C of 45 CFR Part 164 164, to prevent use or disclosure of HIPAA. Business Associate shall implement, and shall contractually require that Agent and PHI other subcontractors implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI it creates, receives, maintains, or transmits on behalf of Covered Entitythan as permitted by this Agreement.
