Safety Warranty and Provision of Material Safety Data Sheets. As applicable, the Goods supplied to the District under this Contract shall conform to applicable standards promulgated by the U.S. Department of Labor under the Occupational Safety and Health Act ("OSHA") of 1970. In the event the Goods do not conform to OSHA standards, the District will be permitted to refuse or return the non-conforming Goods for correction or replacement at the Vendor’s expense. Where Goods to be delivered under this Contract require the maintenance of Material Safety Data Sheets ("MSDS"), a copy of the relevant MSDS will be made available to the District’s representative prior to delivery of the relevant Goods.
