Safetycertificationpriorto Final COD. The Concessionaire shall, not later than 30 (thirty) days prior to the likely Final COD, notify the AuthorityandtheIndependentExpertofthecomplianceofSafetyRequirementsandinvitethemtoobserveanyo ▇▇▇▇ the tests that may be specifiedby the Independent Expert in accordance with Applicable LawsandGoodIndustryPracticetodetermineandcertifythattheProjectissafeforenteringintocommercial service, and the costs of such tests shall be shared equally between the Concessionaire andthe Authority; provided that in case of failure in any test requiring repetition thereof, the cost of suchsecondorsubsequenttestshallbeborneentirelybytheConcessionaire.
