Common use of Sale by JPS and Purchase by the Company Clause in Contracts

Sale by JPS and Purchase by the Company. Subject to, and in accordance with the terms of this Agreement and the applicable standard terms and conditions of contract governing the supply of electricity to JPS’ customers, JPS shall make available and sell to the Company, and the Company may purchase from JPS, capacity and energy, in accordance with applicable rate schedules, as determined by the Office of Utilities Regulation (hereinafter referred to as “the OUR”).

Sale by JPS and Purchase by the Company. Subject to, and in accordance with the terms of this Agreement and the applicable standard terms and conditions of contract governing the supply of electricity to JPS’ customers, JPS shall make available and sell energy to the Company, and the Company may purchase from JPS, capacity and energy, in accordance with applicable rate schedules, as determined by the Office of Utilities Regulation (hereinafter referred to as the “the OUR”).

Subject to, and in accordance with the terms of this Agreement and the applicable standard terms and conditions of contract governing the supply of electricity to JPS’ customers, JPS shall make available and sell to the Company, and the Company may purchase from JPS, capacity and energy, in accordance with applicable rate schedules, on the same basis as determined by the Office of Utilities Regulation (hereinafter referred JPS’ then prevailing tariff for electricity sold to as “the OUR”)industrial customers.
