SALE OF PURCHASER'S PROPERTY. 18.1. This entire agreement is subject to the sale of certain existing immovable property situated at within a period of 30 days from date of this agreement; the fulfillment of all and any suspensive conditions to be contained in such sale within a period of 21 days from date of the sale; and the successful conclusion of such sale (registration of transfers of ownership) within a period of three-months from date of the sale or the date of fulfillment of the suspensive conditions contained in the such sale, whichever event occurs last. It is recorded that the Seller shall have the right, in the Seller’s sole discretion, to extend in writing any of the aforesaid periods once for each period and for no longer than 20 days for each period. OR (if Property already sold) 18.2. It is recorded that the Purchaser has sold certain existing immovable property situated at and that this agreement is subject to the fulfillment of all and any suspensive conditions contained in such sale within a period of 21 days from date of this agreement and the successful conclusion of such sale (registration of transfer of ownership) within a period of three-months from date of this agreement or the date of fulfillment of the suspensive conditions contained in the such sale, whichever event occurs last. It is recorded that the Seller shall have the right, in the Seller’s sole discretion, to extend in writing any of the aforesaid periods once for each period and for no longer than 20 ordinary days for each period. 18.3. It is recorded that in the event of the suspensive condition referred to in this paragraph being fulfilled, it is the understanding and agreement between the parties that notwithstanding anything elsewhere provided for in this agreement the parties will endeavour to cause the registration of the transfer of the Property purchased in terms of this agreement to be registered at the same time as the transfer of the Purchaser's property. The Purchaser accordingly agrees to pay the transfer duty on this transaction (if any) to the Seller's conveyancers when required so to do, so as to enable the simultaneous registration to occur.

It is recorded that the Seller seller shall have the right, right in the Sellerseller’s sole discretion, discretion to extend in writing any of the aforesaid periods once for each period and for no longer than 20 ordinary days for each period.
18.320.2 Should the Seller at any time prior to fulfilment of all the suspensive conditions referred to in this agreement receive a bona fide offer to purchase the Property from another Purchaser, which the Seller finds acceptable and wishes to accept, then the Seller shall be entitled to notify the Purchaser of such intention in writing and the Purchaser shall then have 3 days (excluding Saturdays, Sundays, public holidays and the day on which the notice was delivered, if delivered after midday on such day) from day of delivery of the notice to cause such suspensive conditions to be approved and deliver proof thereof to the Seller and if any suspensive conditions remain unfulfilled then to waive in writing the benefit of such l suspensive condition/s, thereby binding the Purchaser to unconditionally purchase the Property, failing which this agreement shall lapse and a be of no further force or effect.
20.3 Notwithstanding the above provision it is agreed that the seller may not provide the notice stipulated for until all suspensive conditions in the competing offer have been fulfilled. It is however agreed that where the competing offer is contractually contingent upon the transfer of another property which has already been sold the suspensive condition in the competing offer relating thereto will be deemed to have been fulfilled when all the suspensive conditions in the agreement relating to the sale of the contractually contingent property have been fulfilled.
20.4 It is recorded that in the event of the suspensive condition referred to in this paragraph being fulfilled, it is the understanding and agreement between the parties that notwithstanding anything elsewhere provided for in this agreement the parties will endeavour to cause the registration of the transfer of the Property property purchased in terms of this agreement to be registered at the same time as simultaneously with the transfer of the Purchaser's property. The Purchaser accordingly agrees to pay the transfer duty on this transaction (if any) to the Seller's conveyancers when required so to do, so as to facilitate and enable the simultaneous registration to occur.
