Common use of Sale to the Purchasers Clause in Contracts

Sale to the Purchasers. Subject to the terms and conditions hereof, the Company will issue and sell to each Purchaser the number of Shares set forth opposite such Purchaser's name on the signature page and the number of Warrants to purchase the number of Shares of Common Stock as set forth opposite such Purchaser's name on the signature page hereto for the purchase price indicated on the signature page hereto ("Purchase Price."). The obligations of each Purchaser hereunder are several and not joint and no Purchaser shall be obligated to purchase any number of Shares in excess of the number set forth opposite such Purchaser's name on the signature page hereto.

Sale to the Purchasers. Subject to the terms and conditions hereof, the Company will issue and sell to each Purchaser the number of Shares set forth opposite such Purchaser's name on shares (the signature page and the number of Warrants to purchase the number of Shares "Shares") of Common Stock as of the Company, no par value per share (the "Common Stock"), set forth opposite such Purchaser's name on the signature page hereto for the at a purchase price indicated on of $0.644 per Share (the signature page hereto ("Purchase Price."). The obligations of each Purchaser hereunder are several and not joint and no Purchaser shall be obligated to purchase any number of Shares in excess of the number set forth opposite such Purchaser's name on the signature page hereto.

The obligations of each Purchaser hereunder are several and not joint and no Purchaser shall be obligated to purchase any number of Shares in excess of the number set forth opposite such Purchaser's name on the signature page hereto.
