Common use of Sale to the Purchasers Clause in Contracts

Sale to the Purchasers. Subject to the terms and conditions hereof, the Company will issue and sell to each Purchaser the number of Shares set forth opposite such Purchaser's name on the signature page and the number of Warrants to purchase the number of Shares of Common Stock as set forth opposite such Purchaser's name on the signature page hereto for the purchase price indicated on the signature page hereto ("Purchase Price."). The obligations of each Purchaser hereunder are several and not joint and no Purchaser shall be obligated to purchase any number of Shares in excess of the number set forth opposite such Purchaser's name on the signature page hereto.

Sale to the Purchasers. Subject to the terms and conditions hereof, the Company will issue and sell to each Purchaser the number of Shares set forth opposite such Purchaser's name on the signature page hereto at a purchase price of $4.00 per share (the "Purchase Price") and the number of Warrants a Warrant to purchase the number of Shares shares of Common Stock as set forth opposite such Purchaser's name on the signature page hereto for the purchase price indicated on the signature page hereto ("Purchase Price.")hereto. The obligations of each Purchaser hereunder are several and not joint and no Purchaser shall be obligated to purchase any number of Shares in excess of the number set forth opposite such Purchaser's name on the signature page hereto.
