Common use of SBBC Disclosure of Education Records Clause in Contracts

SBBC Disclosure of Education Records. (a) SBBC staff will provide VENDOR with the education records listed in this section for the following purpose(s): 1) To provide access for PSAT, SAT, Pre-ACT, and ACT student practice comprising of self-paced additional resources and adaptive branching technology videos in English Language Art, Math, and ACT-Science.. 2) To provide access to computer-adaptive individual practice with thousands of questions through the VENDOR question bank. 3) The ability to log in and track performance on assessments and other in-app activities including attendance. (b) SBBC will provide VENDOR with the following education records via SBBC’s integration system: 1) Student First and Last Name 2) Student Email 3) Subject Section and Course Name 4) Student Identification Number (c) In addition to the education records being disclosed by SBBC staff in Section 2.04(b), VENDOR will also have access to work and information input by students on VENDOR's online platform, including, Student work (student responses to in- app and practice questions), Student in-app performance. VENDOR shall comply with the Children’s Online Privacy Protection Act of 1998 (COPPA), 15 U.S.C. 6501-6505, and its corresponding Children’s Online Privacy Protection Rule, 16 CFR Part 312. In instances where students under the age of thirteen (13) years enter personally identifiable work and information into VENDOR’s online platform, or when VENDOR engages in passive tracking of children’s personal information, SBBC shall obtain written verifiable consent from each student’s parent/guardian as required by COPPA. (d) VENDOR is considered a "school official" with a legitimate educational interest to receive the types of information from SBBC student education records for the purposes listed above. Pursuant to the Family Educational Rights and Privacy Act (FERPA), 34 CFR 99.31(a)(1), these records may be provided without prior parental consent. Prior written consent of the parent or student age 18 or over is needed for any types or purposes of disclosures of education records beyond those listed in this section. (e) The requirements of this section shall supersede any uses and disclosures of education records or the like as listed in VENDOR’s privacy policies if any.

(a) SBBC staff will provide VENDOR with Istation, the education records listed in this section for the following purpose(s):purposes: 1) To provide access implement the Istation Spanish reading curriculum and instruction, including computer-adaptive activities to assess learners’ literacy skills in Spanish, for PSAT, SAT, Pre-ACT, and ACT student practice comprising of self-paced additional resources and adaptive branching technology videos in English Language Art, Math, and ACT-Science..students from K to 8th Grade 2) To provide to create unique accounts for each student user to access to computer-adaptive individual practice with thousands of questions through the VENDOR question banksoftware program. 3) The ability to log in create reports for teachers and track performance administrators to guide instruction based on assessments and other in-app activities including attendanceassessment reports. 4) analysis/reporting of demographic information. (b) SBBC will provide VENDOR with Istation, through the following District's integration system the education records via SBBC’s integration systembelow: 1) Student First first and Last Name last name 2) Student Email identification number (ID) / Single Sign On (SSO) 3) Subject Section and Course NameStudent username 4) Student Identification Numbergrade level 5) School name (c) In addition to the education records being disclosed by SBBC staff in Section 2.04(b), VENDOR Istation will also have access to work and information input by students on VENDORin Istation 's online platformplatform including student-generated content, includingstudent audio files, Student work (writings, student responses to in- app progress on activities, student usage, student activity and practice questions), Student in-app performanceassessment performance and score inputs. VENDOR Istation shall comply with the Children’s Online Privacy Protection Act of 1998 (COPPA), 15 U.S.C. 6501-6505, and its corresponding Children’s Online Privacy Protection Rule, 16 CFR Part 312. In instances where students under the age of thirteen (13) years enter personally identifiable work and information into VENDORIstation’s online platform, or when VENDOR Istation engages in passive tracking of children’s personal information, SBBC shall obtain written verifiable consent from each student’s parent/guardian as required by COPPA. (d) VENDOR Istation is considered a "“school official" ” with a legitimate educational interest to receive the aforementioned types of information from SBBC student education records for the purposes listed above. (a) SBBC staff will provide VENDOR VEI with the education records listed in this section for the following purpose(s):purposes: 1) To provide access to create student accounts for PSAT, SAT, Pre-ACT, log in and ACT student practice comprising use of self-paced additional resources VEI’s entrepreneurship program and adaptive branching technology videos in English Language Art, Math, and ACT-Science..global business simulation that facilitates the transformation of students into business professionals with an entrepreneurial mindset by bringing the workplace into the classroom. 2) To provide access to computercollect de-adaptive individual practice with thousands of questions through identified education records (via student surveys) to improve the VENDOR question bank. 3) The ability to log in and track performance on assessments and other in-app activities including attendance.VEI program, see Attachment C. (b) SBBC will provide VENDOR VEI with the following personally identifiable education records via the SBBC’s integration system: 1) Student First : student first and Last Name 2) Student Email 3) Subject Section and Course Name 4) Student Identification Numberlast name. (c) In addition to the education records being disclosed by SBBC staff in Section 2.04(b), VENDOR VEI will also have access to work and information student surveys (that do not contain personally identifiable information) input by students on VENDOR's online platforminto survey monkey. Survey responses such as student’s general information, includingstudent engagement, Student work (student responses to in- app participation, and practice questions), Student in-app performancestudent outcome. VENDOR VEI shall comply with the Children’s Online Privacy Protection Act of 1998 (COPPA), 15 U.S.C. 6501-6505, and its corresponding Children’s Online Privacy Protection Rule, 16 CFR Part 312. In instances where students under the age of thirteen (13) years enter personally identifiable work and information into VENDOR’s VEI online platform, or when VENDOR VEI engages in passive tracking of children’s personal information, SBBC shall obtain written verifiable consent from each student’s parent/guardian as required by COPPAXXXXX. (d) VENDOR VEI is considered a "school official" with a legitimate educational interest to receive the aforementioned types of information from SBBC student education records for the purposes listed above. (a) SBBC staff will provide VENDOR with the education records listed in this section for the following purpose(s): 1) To provide students with licenses to access its online digital homework platform, called Sofia, which includes 18,000 algorithmic question templates for PSAT, SAT, Pre-ACT, middle school and ACT student practice comprising of self-paced additional resources and adaptive branching technology videos in English Language Art, Math, and ACT-Science..high school math. 2) To provide access to computer-adaptive individual practice with thousands of questions through enroll the VENDOR question bank.students in the Sofia platform 3) The ability To allow Xxxxx to log in and track performance on assessments and other in-app activities including attendance.the scores of assignments taken by the students 4) To allow Xxxxx to post grades back to the Canvas platform (b) SBBC will provide VENDOR with the following education records via SBBCthe District’s integration systemIntegration System: 1) Student First and Last Name name 2) Student Email Last name 3) Subject Section and Course NameE-mail address 4) Student Identification NumberSchool name 5) Math courses that students are enrolled in. (c) In addition to the education records being disclosed by SBBC staff in Section 2.04(b), VENDOR will also have access to work and information input by students on in VENDOR's online platform, including, Student work (student responses to in- app assignments taken, and practice questions), Student in-app performancegrades achieved. VENDOR shall comply with the Children’s Online Privacy Protection Act of 1998 (COPPA), 15 U.S.C. 6501-6505, and its corresponding Children’s Online Privacy Protection Rule, 16 CFR Part 312. In instances where students under the age of thirteen (13) years enter personally identifiable work and information into VENDOR’s online platform, or when VENDOR engages in passive tracking of children’s personal information, SBBC shall obtain written verifiable consent from each student’s parent/guardian as required by COPPA. For example, teachers can build lessons for PSATstudents using the DE platform for Language Arts, SATScience, Pre-ACT, and ACT student practice comprising of self-paced additional resources and adaptive branching technology videos in English Language Art, Social Studies or Math, and ACT-Science... 2) To provide For students to have access and ability to computer-adaptive individual practice with thousands of questions through the VENDOR question bankuse DE’s online system and access all resources included. 3) The ability For students to log in have access to take practice tests, retrieve homework and track performance on assessments and other in-app activities including attendancesubmit assignments. (b) SBBC will provide VENDOR DE with the following education records via SBBCthe District’s data integration system: 1) Student First student’s first and Last Name last name 2) Student Emailstudent’s identification number 3) Subject Section and Course Name student’s course schedule 4) Student Identification Numberstudent’s grade level (c) In addition to the education records being disclosed by SBBC staff in Section 2.04(b), VENDOR DE will also have access to work and information input by students on VENDOR's in DE’s online platform, including: quiz answers, Student quiz results, work (student responses to in- app activities, and practice questions), Student in-app performancesubmitted assignment. VENDOR DE shall comply with the Children’s Online Privacy Protection Act of 1998 (COPPA), 15 U.S.C. 6501-6505, and its corresponding Children’s Online Privacy Protection Rule, 16 CFR Part 312. In instances where students under the age of thirteen (13) years enter personally identifiable work and information into VENDORDE’s online platform, or when VENDOR DE engages in passive tracking of children’s personal information, SBBC shall obtain written verifiable consent from each student’s parent/guardian as required by COPPA.
