Common use of Schedule of Credits and Charges Clause in Contracts

Schedule of Credits and Charges. Effective on October 1 of any year, and upon not less than 90 days’ notice to Company, TVA may modify, change, replace, or adjust the Schedule of Credits and Charges; provided however, adjustments under this subsection will be in accordance with subsection 4.2.5 below. Prior to becoming effective, TVA will share with Company the rolling term IP Product valuation curve methodology and any changes in the Schedule of Credits and Charges. Further TVA will not change or adjust the DCA established on October 1, 2015 (FY 16 DCA), until such time as TVA determines that the value produced by the methodology used by TVA to establish the DCA exceeds the FY16 DCA.
