Common use of School Concurrency Approval Clause in Contracts

School Concurrency Approval. Issuance of a SCADL by the School Board identifying that adequate FISH Capacity exists indicates only that school facilities are currently available. FISH Capacity will not be reserved until the local government issues a Concurrency Evaluation Finding of Nondeficiency, or the functional equivalent. (a) A local government shall not issue a Concurrency Evaluation Finding of Nondeficiency or functional equivalent for a residential development until receiving confirmation of available FISH Capacity in the form of a SCADL from the School Board. Once the local government has issued a Concurrency Evaluation Finding of Nondeficiency or functional equivalent school concurrency for the residential development shall be valid for the life of the Concurrency Evaluation Finding of Nondeficiency or functional equivalent. Expiration, extension or modification of a Concurrency Evaluation Finding of Nondeficiency or functional equivalent for a residential development shall require a new review for adequate FISH Capacity to be performed by the School Board. (b) Local governments shall notify the School Board within ten (10) working days of any official change in the validity (status) of a Concurrency Evaluation Finding of Nondeficiency or functional equivalent for a residential development. (c) The Local Government shall not issue a building permit or its functional equivalent for a non-exempt residential development until receiving confirmation of available FISH Capacity from the School Board in the form of a SCADL. Once the local government has issued a Concurrency Evaluation Finding of Nondeficiency or functional equivalent, school concurrency for the residential development shall be valid for the life of the Concurrency Evaluation Finding of Nondeficiency or functional equivalent.
