School’s Obligations. The School shall:
3.1 Make available suitable premises and staff for the School and ensure that such premises comply with all relevant legal requirements.
3.2 Operate an Equal Opportunities Policy and ensure that the School’s culture, policies and procedures are accessible to children who have disabilities. The School shall ensure compliance with legal responsibilities under equality legislation, including making reasonable adjustments in order to minimise any disadvantage a Child may face as a result of their disability.
3.3 ▇▇▇▇▇▇ good relationships between children and staff. Bullying, harassment, victimisation and discrimination will not be tolerated.
3.4 Ensure that the School shall be open Monday to Friday during normal School hours as notified to Parents each day of the year with the exception of training days, Bank Holidays and School holidays, the dates for which will be as published.
School’s Obligations. To the extent required for Parashift to perform the Services described in this clause 4 , the School:
(a) must give Parashift access that it reasonably requires (including by a functional VPN) to:
(i) the Content (subject always to clause 8); and
(ii) the Users and the School's Personnel;
(b) must, in Parashift's provision of the Services, provide unhindered, uninterrupted access to the School's hardware and systems, including to provide remote access to its computer systems in a form and manner reasonably nominated by Parashift for the purpose of Parashift providing remote support (if Parashift elects to do so); and
(c) must ensure that the School's equipment and products used by Parashift in connection with the Services will be reasonably fit for the purposes for which they are used.
School’s Obligations. Upon acceptance of the Agreement and at times during the term of this Agreement when requested by the Provider, the School shall provide, deliver and/or designate the following:
School’s Obligations. The School shall:
a) Provide tuition to the Student in accordance with the New Zealand Ministry of Education Code of Practice for the Pastoral Care of International Students.
b) Observe and be bound by the Ministry of Education’s Code of Practice for the Pastoral Care of International Students. Copies are available on request from the School or from the NZQA website at ▇▇▇▇://▇▇▇.▇▇▇▇.▇▇▇▇.▇▇/providers-partners/education-code-of-practice/.
c) Provide tuition in accordance with that provided to domestic students.
d) Only accept international students who live with their parent/legal guardians or are who with designated caregivers selected by the Applicant or with a host family approved by the School.
i) If the Student is living with their parent/legal guardian or a designated caregiver is nominated by the Applicant, then the school will have all care for but no responsibility for the Student outside of school hours, with the exception of any school event which parents/caregivers/host family have given consent for the student to attend.
ii) The School reserves the right to be involved in, and may take action over incidents outside the School which have some association with and/or bearing on the welfare and progress of the Student, other students, incidents or activities within the School.
e) Give notices in writing under the terms of this agreement to the addresses set out in the application forms.
f) Use its best endeavours to ensure the safety, health and wellbeing of the Student and in so doing shall not be liable for:
i) Any damage or harm caused to the Student or the Student’s property while attending the school.
ii) Any damage or harm caused to the Student or the Student’s property arising out of the Student’s homestay (whether or not such homestay was arranged by or through the school).
iii) Any damage or harm caused to the Student or the Student’s property outside of normal school hours or outside the School’s premises.
School’s Obligations. 5.1 Save as otherwise expressly provided, the obligations of the School under the Agreement are obligations of the School in its capacity as a contracting counterparty and nothing in the Agreement shall operate as an obligation upon, or in any other way ▇▇▇▇▇▇ or constrain the School in any other capacity, nor shall the exercise by the School of its duties and powers in any other capacity lead to any liability under the Agreement (howsoever arising) on the part of the School to the Contractor.
School’s Obligations. The School undertakes to provide tuition in accordance with the School Material. The School reserves the right to amend the School Material from time to time and any reference to the School Material herein is a reference to the most up-to-date School Material. The manner the School provides tuition may be varied by the School (acting reasonably). If required (as determined by the School at its discretion), the School may provide tuition by way of virtual schooling, in accordance with the School Material. Nothing contained in the School Material binds the School to any specific procedures or policies, and nothing in the School Material creates a contractual obligation, express, implied, unilateral, or otherwise, between Parents and the School.
School’s Obligations. The School will comply with the payment provisions of Schedule 2 provided that the School has received full and accurate information and documentation as required by Schedule 2 to be submitted by the Contractor for work completed to the satisfaction of the School.
School’s Obligations. 6.1 The School will:
(a) provide The Stonefields School Collaborative Trust with all necessary cooperation in relation to this Agreement, and all necessary access to such information as may be required by The Stonefields School Collaborative Trust, so that The Stonefields School Collaborative Trust can provide the Services including but not limited to School Data, security access information and configuration services;
(b) comply with all applicable laws and regulations with respect to its activities under this Agreement;
(c) carry out all other School responsibilities set out in this Agreement in a timely and efficient manner. In the event of any delays in the School's provision of such assistance as agreed by the parties, The Stonefields School Collaborative Trust may adjust any agreed timetable or delivery schedule as reasonably necessary;
(d) ensure that the Authorised Users use the Subscription Services and the Documentation in accordance with the Terms of Use, Privacy Policy, and Code of Conduct (where applicable);
(e) be responsible for all acts and omissions of the other Authorised Users as if those acts and omissions are those of the School. School will indemnify The Stonefields School Collaborative Trust against all costs, losses, damages and expenses arising out of or in connection with the Authorised Users’ use of the Subscription Services;
(f) ensure that its network and systems comply with the relevant specifications as may be specified by The Stonefields School Collaborative Trust from time to time; and
(g) be solely responsible for procuring and maintaining its network connections and telecommunications links from its systems to The Stonefields School Collaborative Trust’s data centres, and all problems, conditions, delays, delivery failures and all other loss or damage arising from or relating to the School's network connections or telecommunications links or caused by the internet.
School’s Obligations. 5.1 The prevailing KTJ Parent Handbook and the KTJ Rules and Sanctions Handbook as at the date of execution of this Contract contain information regarding the School and its Policies such as the curriculum or the manner of providing education for its Students. The School reserves the right to change the contents of these handbooks and to update the same at their discretion, but whenever possible the School will give notice of the proposed changes by the end of the term before the term during which the changes are to take effect.
5.2 Subject and in addition to the Student attaining the minimum academic standard, consistently maintaining satisfactory disciplinary or behavioural records throughout his past academic years with the School and the availability of a dormitory place and day place, the School has the absolute discretion to determine whether or not to continue to provide a place for the Student when:-
(a) Transitioning from primary into secondary;
(b) Transitioning into the sixth form; or
(c) In all other circumstances. In the event that the Parents are dissatisfied with the School’s decision, they may raise it with the School in accordance with the School’s Complaints Policy and Procedures, which is available on the School’s website.
5.3 While the Student remains a Student of the School, the School undertakes to exercise reasonable skill and care in respect of his education and welfare. This obligation will apply during School hours and at other times when the Student is permitted to be in the School premises or is participating in activities organised by the School.
5.4 The School will not subject the Student to corporal punishment. This prohibition includes the administration of corporal punishment to a Student during any activity, whether or not within the School premises, and applies to all members of staff. However, the School reserves the right for its academic staff to use reasonable force to control or restrain a Student in specific circumstances deemed to be necessary, to prevent a Student from doing or continuing to do any of the following:
(a) Committing any offence;
(b) Causing personal injury to any person including the Students themselves; or
(c) Causing damage to the property of any person including their own property.
5.5 Unless the Parents notify the School in writing to the contrary, the Parents hereby consent to the Student participating, under proper supervision, in contact sports and in other normal sports and activities which may en...
