Scope and UseThe parties hereto agree that all Programs and Services identified in Schedule “B” are to be delivered by the GRCA to the Municipality pursuant to and in accordance with this Memorandum of Understanding and any and all Letter Agreements.
Scope and Use. The only activities which Concessionaire shall be permitted to engage in on the premises of Concession Area 23 is the rental or sale of umbrellas and chairs. No glass containers will be allowed on or about the premises. All city codes must be complied with and all needed permits obtained prior to the sale or lease. This is a non-exclusive concession.

You are hereby granted a non-exclusive, non-assignable, non-transferable license to access the Product (i) only in up to 5 (Five) Licensed Units, (ii) for Personal, Non-Commercial Use and Commercial Use, and (iii) subject to the terms and conditions of the Agreement. b. The Product is protected from extraction by the end user so that they may not access the Product on its own outside of your application. ii. Your digital document or application is not designed to serve the same function as the Product, i.e. the document must not allow end-users to use glyphs from the Product for use in their own designs. d. You may use the product in graphics, videos, video games, broadcasts and other visual media as long as they meet the criteria defined above for digital documents and software applications. e. You may not install the Product on an online server unless all devices capable of accessing the Product are Licensed Units. f. You may not lend, rent, sublicense, sell, disassemble or reverse-engineer the Product. g. You may provide the Product to a third-party only to facilitate the uses described in 3a, 3b, 3c and 3d. For example, you may provide the Product to a third-party printing company if they need it to print your merchandise. h. You may not use the product for illegal activities. i. You may not remove watermarks, materials, restrictions or copyright notices from the Product. j. You may not use the Product or graphics containing the product to train generative AI models, Language Learning Models, Machine Learning programs or any other kind of program designed to automatically reproduce content similar to the Product after analyzing the Product. Failure to abide by this clause is subject to a licensing fee of $10,000 USD per infringement. Ignorance of the origin of the Product is not a defence against breaching this agreement.
Scope and UseUse of the System and its data, including but not limited to contact information, shall be governed by the terms and conditions set forth in the Public Mass Notification System Policies and Guidelines (“Policies and Guidelines”) approved by the Steering Committee, as hereinafter defined, attached hereto as Exhibit A. Each Participant, including each of its agents, officers, employees and representatives with access to the System, agree to the terms and conditions contained in the Policies and Guidelines. The Policies and Guidelines may only be modified by majority vote of the Steering Committee. Participant’s use of the System is limited to using the System to distribute business communications to Participant’s own internal resources and to communicate emergency and non-emergency notifications to the public. Any other uses not authorized by the vendor agreement are prohibited. No other uses are authorized. Each Participant agrees to comply with all federal, state, and local laws and regulations applicable to its use of the System.

Scope and Use. 6.1 Use of AlertSCC and its data, including but not limited to contact information, is governed by the terms, conditions and restrictions set forth in the terms provided in this Participant Agreement, Exhibits A and B to this Participant Agreement, and the then current BCI Acceptable Use Policy and Privacy Policy. Participant agrees to the terms and conditions contained therein. In consideration for Participant’s acceptance of said terms and conditions, County agrees to provide Participant with access to AlertSCC at no charge during the term of this Participant Agreement. 6.2 County retains the right to modify or update Exhibits A and B as needed, in whole or in part, during the term of this Participant Agreement. Participant hereby consents to said modifications or updates. County will distribute to Participant any and all revised exhibits within ten (10) business days of the revision date. Upon transmission by County to Participant, the revised exhibits shall thereby be incorporated into this Participant Agreement. The revised exhibits shall not constitute a modification for purposes of Section 5 to this Participant Agreement. 6.3 Participant, including each of its agents, officers, employees, and representatives who are given access to AlertSCC, agrees to abide by the individual terms of each agreement and the additional conditions incorporated herein. Breach of use shall result in immediate individual user or Participant access account termination. 6.4 The scope of services under this Participant Agreement is limited to using AlertSCC to provide notification to Participant inter-departmental resources and/or the public as described in the “AlertSCC, Santa Xxxxx County Regional Mass Notification System Policy and Procedure Manualattached hereto as Exhibit B. 6.5 Participant has received, read and understood the terms and conditions found in “AlertSCC, Santa Xxxxx County Regional Mass Notification System Policy and Procedure Manual” attached hereto as Exhibit B. Participant hereby accepts said terms and conditions. 6.6 AlertSCC has a built in geo-referencing capability. However, the County is providing the County Regional Geographical Information System (GIS) Basemap to support this capability instead to provide more current and accurate data for all joining entities to use in this service. Scope and Use. A Work Statement is a project description for a particular Phase which refers to this Agreement, describes work to be done in connection with such Phase pursuant to this Agreement, identifies the Deliverables to be produced there under, and provides a breakdown of Deliverables into specific 2 categories as further specified in Section 3.2(b) hereof. Each Work Statement shall identify the services, functions, equipment, facilities and other resources to be provided by each party in order for the tasks specified in such Work Statement to be performed.

No other use is permitted. A. Concessionaire must operate in a safe manner. The Hamster Balls are to stay on land and cannot be used in the water. If Concessionaire allows the Hamster Ball to go into the water, Park Board will have the right to immediately terminate the Agreement. B. Concessionaire agrees that before any customer is allowed inside a Hamster Ball, they will sign a release. The form of the release must be approved by the Park Board before operating under this agreement. The Hamster Ball user must release the Park Board and City from any liability caused or connected in any way to their use of the Hamster Ball. C. No portion of the concession premises is being leased to Concessionaire. Concessionaire is a licensee and not a leasee of the concession premises, and the right of Concessionaire to occupy the concession premises shall continue only so long as all of the terms of this Agreement are strictly and promptly complied with by Concessionaire. D. Park Board retains the right to award other concession agreements, licenses, or permits to other parties, and to make any improvements it deems necessary to the beach during the term of this Agreement. This Agreement is non-exclusive. There may be other vendors that rent the same or similar products.
