Second Hand Goods Clause Samples
The 'Second Hand Goods' clause defines the terms and conditions under which used or previously owned items are sold or transferred between parties. Second Hand Goods. (a) For Goods not manufactured by the Superior Jetties, any warranty provided shall be the current warranty provided by the manufacturer of the Goods. To the extent permitted by Law, Superior Jetties will not be bound by nor be responsible for any term, condition, representation or warranty other than that which is given by the manufacturer of the Goods or as required by Law.
(b) In the case of second hand Goods (including goods supplied by the Customer), the Customer acknowledges that it has had full opportunity to inspect the Goods and that they accept the Goods with all faults and that no warranty is given by Superior Jetties as to the quality or suitability for any purpose and any implied warranty, statutory or otherwise, is expressly excluded. Superior Jetties will not be responsible for any loss to the Goods or Claim caused or arising in connection with the Goods.
Second Hand Goods unless a pre-shipment survey is completed by the Client, submitted to and accepted by the Courier in advance of shipment.
Second Hand Goods. If we agree to sell you second-hand Goods, you acknowledge that: (i) the Goods are second hand and sold 'as is'; (ii) it lacks support (including manufacturer's support), operating manuals, and associated documentation and any applicable licence; (iii) you made your own enquiries about its condition and suitability (including working condition); and (v) we are not a dealer in second-hand goods. To the fullest extent possible, but without intending to exclude the application of any consumer guarantee or other non- excludable right under the Competition and Consumer Act 2010 (Cth) or any other applicable Law: (i) we provide no express or implied warranties regarding the Goods’ condition, state, quality, operation, durability, suitability, fitness for use or any purpose or merchantability; and (ii) you release us from any related claims and liabilities.
Second Hand Goods. 28.1 In the case of second-hand Goods, You acknowledge and agree that:
(a) You have had full opportunity to inspect the second hand Goods prior to entering into this Agreement;
(b) You accept the Goods within the condition as at the Delivery Time;
(c) other than as set out in clause 6, no warranty is given by KH in respect of the Goods; and
(d) KH has agreed to provide You with the second-hand Goods and calculated the Price of the second hand Goods in reliance on this clause 29.
Second Hand Goods. Although every care is taken to ensure that all second-hand goods supplied by Prebbleton IT are of merchantable quality, no warranty is expressed or implied unless otherwise stated.
