Secondary Education Contribution. 2.1. The Owner covenants to provide the County Council with the Updated Housing Mix within 7 Working Days of the grant of the final Reserved Matters Area Approval or planning permission which contains Residential Units for each of the Neighbourhood Areas 1, 2 and 3 in order that the County Council can provide the Owner with the Secondary Education Contribution figure for Neighbourhood Areas 1, 2 and 3 as relevant based on the Secondary Education Contribution Calculation at that time and the Owner covenants to pay the Secondary Education Contribution in respect of the Neighbourhood Areas as follows;
2.1.1. 33% of the Secondary Education Contribution prior to the first Occupation of the 575th Residential Unit;
2.1.2. 33% of the Secondary Education Contribution prior to the first Occupation of the 1150th Residential Unit; and
2.1.3. 34% of the Secondary Education Contribution prior to the first Occupation of the 1725th Residential Unit;
1. Definitions
Secondary Education Contribution. The Owner covenants with the County Council as follows:
Secondary Education Contribution. On receipt of a notice pursuant to Schedule 8 to calculate the Secondary Education Contribution and Spare Places in accordance with this Agreement and in manner as demonstrated in the Education Methodology appended to this document at Appendix 1.

Secondary Education Contribution. The Owner covenants that it shall pay to the Borough Council the Secondary Education Contribution for each Phase before Occupation of 50% of the Dwellings in that Phase The Owner covenants that it shall not Occupy 50% or more of the Dwellings in each Phase unless and until the Secondary Education Contribution for that Phase has been paid to the Borough Council the Owner has notified the Borough Council of this payment The Borough Council shall not transfer the Secondary Education Contribution (or any part thereof) (together with any interest accrued thereon) to the County Council unless the Borough Council is satisfied that the County Council will spend the contribution on the Secondary Education Facilities If the Borough Council are of the view that the Secondary Education Contribution will not be spent in accordance with Paragraph 8.3 the Borough Council shall repay such of the Secondary Education Contribution as the Borough Council is holding to the person who paid the contribution with accrued interest (if any) but less any tax that may be payable thereon and the Borough Council’s administrative expenses
