Section 2 - Grievance Procedure. All grievances shall be settled in accordance with the following procedure. However, upon mutual agreement of the parties, any step in the procedure may be waived.

Step 1: Within twenty-one (21) calendar days after the grievant, through the use of reasonable 13 diligence, should have knowledge of the event giving rise to the grievance, the grievant and/or 14 Association representative shall arrange a meeting with the grievant's immediate supervisor to 15 resolve the grievance. If the grievance is not 16 resolved within three (3) days of this meeting, the grievance and must be reduced to writing, 18 to the grievance shall be given to the grievant and/or Association representative within fifteen 19 (15) calendar days of said meeting.

Section 2 - Grievance Procedure. 15 (A) The parties agree that all complaints should be resolved, 16 whenever possible, with the Site manager and the employee 17 involved. Any employee with a complaint or issue should contact 18 the Site manager in order to discuss and resolve the issue, if the 19 employee desires, the responsible ▇▇▇▇▇▇▇ may attend this initial 20 step. Both parties will make every effort to resolve the issue. If 21 the complaint cannot be resolved between the parties involved, 22 then the ▇▇▇▇▇▇▇ or Union Representative will reduce the 23 complaint to writing. 24 (B) The following procedures apply in attempting to settle grievances 25 that are not resolved by Section A. 26 (1) STEP ONE - Once the grievance has been reduced to 27 writing by the ▇▇▇▇▇▇▇ on a form mutually agreed to by the 28 parties, (such written grievance shall set forth the complaint 29 and remedy sought, the facts on which it is based, the 30 date(s) of occurrence, the applicable Article(s) of the 31 Agreement which is claimed to be the basis for the filing of 32 the grievance, dated and signed by the ▇▇▇▇▇▇▇), the 33 grievance must be presented to the Site Manager within five 34 (5) working days from the date the employee became aware 35 of the incident that gave rise to the grievance. If the ▇▇▇▇▇▇▇ 36 fails to present the written grievance within this time limit, the 37 grievance shall be considered settled and no further action 1 can be taken thereon. Both parties will make every effort to 2 resolve the issue.

Step One - Before entering into the following grievance procedure, it is the desire of the Union and the Employer that effort has been made to resolve the problem through direct verbal communication and discussion between the parties involved. Section 2 - Grievance Procedure. For the purpose of peacefully settling all complaints and grievances, both parties will be governed by the grievance procedure as outlined in this article. The Company agrees to meet with the representatives of the Union to settle grievances or disputes at such time as may be necessary and reasonable. The Bargaining Committee may write and sign a grievance on behalf of an employee or group of employees. If the issue raised is not appropriate for resolution at the first or second step, the grievance may be referred by the Bargaining Committee directly to the third step.

In the event of any difference arising between the persons bound by this Agreement concerning its interpretation, application, operation or any alleged violation thereof, it shall be dealt with in the following manner without stoppage of work. A grievance shall be stated in writing and submitted to the Fire Chief by the griever, and a committee if the griever so chooses, within seven (7) days of its occurrence. Should the grievance not be settled within three (3) working days after receipt of the grievance, the grieving party may submit the grievance to the City Administrator and a Union committee. The City Administrator and a committee of up to three (3) qualified representatives of the Union will meet within six (6) working days after receipt of the grievance and make every effort to settle the grievance.
