Common use of Secured Bank Product Provider Clause in Contracts

Secured Bank Product Provider. (a) Bank of the West or any of its Affiliates; and (b) any other Lender or Affiliate of a Lender that is providing a Bank Product, provided such provider delivers a Secured Bank Product Provider Agreement to Agent within 10 days following the later of the Closing Date or creation of the Bank Product.

Secured Bank Product Provider. (a) Bank of the West or any of its Affiliates; and (b) any other Lender or Affiliate of a Lender that is providing a Bank Product, provided that no such provider delivers Lender or Affiliate shall be considered a Secured Bank Product Provider Agreement until ten (10) days following its delivery to Agent within 10 days following of a Secured Bank Product Provider Agreement, unless such agreement has been delivered prior to the later of the Second A&R Closing Date or creation of the Bank ProductDate.
