Security Breach or Unauthorized Disclosure. If Contractor discovers unauthorized release or use of Confidential Information or a security breach, Contractor shall immediately notify the Energy Commission. Contractor shall cooperate with all investigations of the incident, providing the Energy Commission with regular updates on investigation and allow the Energy Commission to participate in all investigations, until the incident is resolved to the Energy Commission’s satisfaction. Contractor shall take steps to mitigate further loss and recover Confidential Information. Contractor shall be responsible for costs incurred due to a security incident or breach.
