Selection of Expert if Parties Do Not Agree. In the event there are no common names on the Parties’ lists (or there is more than one common name and the Parties cannot agree), the lists of potential Experts submitted by the Parties shall be submitted to The International Institute for Conflict Prevention & Resolution (“CPR”) on or before five (5) Business Days after the submission of the Parties’ respective lists to one another, and the CPR shall select the Expert from the Parties’ lists. The Expert need not be on the CPR’s panel of neutrals.
