Common use of Selection of Tenant’s Architect; Construction Drawings Clause in Contracts

Selection of Tenant’s Architect; Construction Drawings. (a) Tenant shall retain an architect/space planner (“Tenant’s Architect”) to prepare the Construction Drawings. Tenant’s Architect shall be subject to the written approval of Landlord, which approval will not be unreasonably withheld or delayed. Tenant shall retain engineering consultants approved by Lxxxxxxx (the “Engineers”), which approval shall not be unreasonably withheld or delayed, to prepare all plans and engineering working drawings relating to the structural, mechanical, electrical, plumbing, HVAC, life-safety and sprinkler work, if any, in the Premises in connection with the Tenant Improvements. The plans and drawings to be prepared by Txxxxx’s Architect and the Engineers hereunder shall be known, collectively, as the “Construction Drawings.” (b) All Construction Drawings shall be subject to Landlord’s approval, which approval shall not be unreasonably withheld or delayed. If available, Landlord shall supply Tenant with a set of drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx agrees that Landlord shall have no liability for the completeness or accuracy thereof, and Txxxxx’s Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systems.

The plans and drawings to be prepared by Txxxxx’s Tenant's Architect and the Engineers hereunder shall be known, collectively, as the “"Construction Drawings.”" (b) All Construction Drawings shall be subject to Landlord’s 's approval, which approval shall not be unreasonably withheld or delayed. If available, Landlord shall supply Tenant with a set of drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and Txxxxx’s Tenant's Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systemsSystems.

The plans and drawings to be prepared by Txxxxx’s Tenant's Architect and the Engineers hereunder shall be known, collectively, as the “"Construction Drawings".” (b) All Construction Drawings shall be subject to Landlord’s 's approval, which approval shall not be unreasonably withheld or delayed. If Landlord shall, if available, Landlord shall supply Tenant with a set of drawings of the Building Buildings which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and Txxxxx’s Tenant's Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systems.

The plans and drawings to be prepared by TxxxxxTenant’s Architect and the Engineers hereunder shall be known, collectively, as the “Construction Drawings”.” (b) All Construction Drawings shall be subject to Landlord’s approval, which approval shall not be unreasonably withheld or delayed. If readily available, Landlord shall may supply Tenant with a set of drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and TxxxxxTenant’s Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systems.

Tenant’s 's Architect and Engineers shall be subject to the written approval of Landlord, which approval will not be unreasonably withheld withheld, conditioned or delayed. Tenant shall retain engineering consultants approved by Lxxxxxxx (the “Engineers”), which approval shall not be unreasonably withheld or delayed, to prepare all plans and engineering working drawings relating to the structural, mechanical, electrical, plumbing, HVAC, life-safety and sprinkler work, if any, in the Premises in connection with the Tenant Improvements. The plans and drawings to be prepared by Txxxxx’s Tenant's Architect and the Engineers hereunder shall be known, collectively, as the “"Construction Drawings.”" (b) All Construction Drawings Upon execution of the Lease, Landlord, at no cost to Tenant, shall be subject to Landlord’s approvalsupply Tenant, which approval shall not be unreasonably withheld or delayedat Tenant's request, with accurate path of travel drawings for the Building. If In addition, if readily available, Landlord shall may supply Tenant with a set of other drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereofof any such drawings, and Txxxxx’s Tenant's Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systems.

If available, Landlord shall supply Tenant with a set of drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and TxxxxxTenant’s Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systemsSystems. To the extent Landlord requires review by third party consultants of any Constructions Drawings, Tenant shall reimburse Landlord for its reasonable out of pocket costs paid to such third-party consultant.

Tenant’s Architect shall be subject to the written approval of Landlord, which approval will not be unreasonably withheld or delayed. Tenant Landlord shall retain engineering consultants approved by Lxxxxxxx (the “Engineers”), which approval shall not be unreasonably withheld or delayed, to prepare all plans and engineering working drawings relating to the structural, mechanical, electrical, plumbing, HVAC, life-safety and sprinkler work, if any, in the Premises in connection with the Tenant ImprovementsImprovements (the “Engineers”). The plans and drawings to be prepared by TxxxxxTenant’s Architect and the Engineers hereunder shall be known, collectively, as the “Construction Drawings.” (b) All Construction Drawings shall be subject to Landlord’s approval, which approval shall not be unreasonably withheld or delayedwithheld. If available, Landlord shall supply Tenant with a set of drawings of the Building which Tenant Tenant’s Architect may use the drawings supplied by Landlord in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and TxxxxxTenant’s Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings. (c) At Landlord’s option, as well as to be exercised in its sole discretion, Landlord may require Tenant to assign Tenant’s rights under its agreement with Tenant’s Architect upon five (5) business days notice from Landlord to Tenant. Tenant has obtained (or will prior to commencement of construction of the physical limitations of Building systemsTenant Improvements) the consent from Tenant’s Architect to such assignment.

Tenant’s Architect shall be subject to the written approval of Landlord, which approval will not be unreasonably withheld withheld, conditioned or delayed. Tenant shall retain engineering consultants approved designated by Lxxxxxxx Landlord (the “Engineers”), which approval shall not be unreasonably withheld or delayed, ) to prepare all plans and engineering working drawings relating to the structural, mechanical, electrical, plumbing, HVAC, life-safety and sprinkler work, if any, in the Premises in connection with the Tenant ImprovementsImprovement to each Phase. The plans and drawings to be prepared by TxxxxxTenant’s Architect and the Engineers hereunder for each Phase shall be known, collectively, as the “Construction Drawings.” (b) All Construction Drawings shall be subject to Landlord’s approval, which approval shall not be unreasonably withheld or delayed. If available, Landlord shall supply Tenant with a set of drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and TxxxxxTenant’s Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systemsSystems. Tenant shall retain engineering consultants approved by Lxxxxxxx (the “"Tenant's Engineers”), which approval shall not be unreasonably withheld or delayed, ") to prepare all plans and engineering working drawings relating to the structural, mechanical, electrical, plumbing, HVAC, life-safety and sprinkler work, if any, in the Premises Expansion Space in connection with the Tenant Improvements. Tenant's Engineers shall be subject to the written approval of Landlord, which approval will not be unreasonably withheld or delayed. The plans and drawings to be prepared by Txxxxx’s Tenant's Architect and the Engineers hereunder shall be known, collectively, as the “"Construction Drawings.”" (b) All Construction Drawings shall be subject to Landlord’s 's approval, which approval shall not be unreasonably withheld or delayed. If available, Landlord shall supply Tenant with a set of drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and Txxxxx’s Tenant's Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such drawings, as well as the physical limitations of Building systems.

Tenant shall retain engineering consultants approved reasonably designated by Lxxxxxxx Landlord (the “"Engineers”), which approval shall not be unreasonably withheld or delayed, ") to prepare all plans and engineering working drawings relating to the structural, mechanical, electrical, plumbing, HVAC, life-safety and sprinkler work, if any, in the Premises in connection with the Tenant Improvements. Landlord shall use commercially reasonable efforts to insure that the rates of the Engineers so designated by Landlord are competitive with those of similarly designated engineers of Comparable Buildings. The plans and drawings to be prepared by Txxxxx’s Tenant's Architect and the Engineers hereunder shall be known, collectively, as the “"Construction Drawings.”" (b) All Construction Drawings shall be subject to Landlord’s 's approval, which approval shall not be unreasonably withheld withheld, conditioned (except as set forth herein) or delayed. If available, Landlord shall supply Tenant with a set of “as-built” drawings of the Building which Tenant may use in connection with the preparation of the Construction Drawings, but Txxxxx Tenant agrees that Landlord shall have no liability for the completeness or accuracy thereof, and Txxxxx’s Tenant's Architect shall be responsible for performing all necessary field measurements and confirming the completeness and accuracy of such as-built drawings, as well as the physical limitations of Building systems.
