Seller as Seller and Operator. Throughout the Term, Seller or Seller’s Lender shall be the legal and beneficial owner of the System at all times, the System shall remain the personal property of Seller or Seller’s Lender, and the System will be operated and maintained in accordance with the Tariff and, as necessary, repaired by Seller at its sole cost and expense. Buyer will not have access to the System for any purpose. Buyer will have no ownership, possession right or control of the System, and will have no rights or obligations with respect to the operation and maintenance of the System. This Agreement does not convey to Buyer any right, title or interest in or to any portion of any property (tangible or intangible, real or personal) underlying or comprising any portion of the System.
