Common use of Seller Limited Warranty Clause in Contracts

Seller Limited Warranty. Seller hereby warrants that all materials incorporated in and made a part of the Unit were new as of the date of installation and that the same shall remain free from defects in workmanship or material for a period of one (1) year from the date of Substantial Completion. Seller shall cause to be remedied, by repair or replacement, without cost or expense to Purchaser, any defects in said materials or workmanship in the materials incorporated in and made a part of the Unit, which appear within one (1) year from the date of Substantial Completion, subject to Purchaser’s timely provision of notice in the manner set forth below, and subject to the limitation specified herein. Purchaser’s sole remedy (in lieu of all remedies implied by law or otherwise) in connection with defects in the Unit shall be to enforce the limited warranties set forth in this subsection (the “Limited Warranty”), with said enforcement subject to the limitations and requirements contained herein.
