Common use of Seller’s Variations Clause in Contracts

Seller’s Variations. (a) To the extent that the Draft Unit Specification or the Disclosure Statement specifies the materials, finishes and utility connections that shall constitute the delivery of the Unit, the Purchaser acknowledges and agrees that the Seller may vary or replace such materials, finishes and utility connections as specified in the Draft Unit Specification and/or the Disclosure Statement with materials, finishes and utility connections of similar, equivalent or higher quality (as determined by the Project Manager in its absolute discretion) and the Purchaser will make no objection, requisition or claim for compensation in respect of such variation. (b) The Purchaser acknowledges and agrees that the details of the design, features, amenities, layout and area of the Unit and the Building, as described in this Agreement and the Disclosure Statement are DRAFT
