The Obligations constitute “Senior Indebtedness” and “Designated Senior Indebtedness” under and as defined in the Senior Subordinated Debt Documents and the Subordinated Promissory Note (and to the extent any Additional Senior Subordinated Notes are issued, the documents governing the Additional Senior Subordinated Notes).

The Obligations constitute “"Senior Indebtedness” " and “"Designated Senior Indebtedness” " under and as defined in the Senior Subordinated Debt Note Documents and the Subordinated Promissory Note (and to the extent any Additional Senior Subordinated Notes are Note Refinancing Indebtedness or Subordinated Acquisition Financing is issued, the documents governing Obligations shall constitute "Senior Indebtedness" and "Designated Senior Indebtedness" (or shall have similar designations having substantially the Additional Senior same effect) under the Subordinated NotesNote Refinancing Documents and the Subordinated Acquisition Financing Documents, as applicable).
