Common use of Service and Programming Enhancements Clause in Contracts

Service and Programming Enhancements. If the Franchisee or an Affiliate provides a new Cable Service, or substantially more Cable Services, on a commercially deployed basis in the Region, then the Franchisee, within eighteen (18) months, shall provide comparable Cable Services to and in the Franchise Area, unless the Franchisee reasonably determines and demonstrates in writing to the Town that doing so would not be Economically and Technically Feasible or that there is insufficient Subscriber demand for such Cable Service.
