Service Characteristics a. Internet packages are advertised as “up to” speeds. This mean, CDEC provides “best-effort” Internet Service for residential and small commercial use. Best-effort Service is defined as the fastest speed you will receive at the testing point and is not a guaranteed constant speed.
b. You are allowed to change your Service package no more than twice in a twelve-month period.
c. CDEC’s fiber optic system is currently in its initial deployment form and during this period, Internet speeds may vary.
d. CDEC reserves the right to interrupt speeds, if necessary, for equipment upgrades and network maintenance.
Service Characteristics. The technical specification of the Inter-CO Fibre Service is set out in Appendix B. The LFC will provide the Service Provider with network optical budget design calculations, and fibre commissioning test results for the Inter-CO Fibre Service. This information with be provided in good faith and the Service Provider will be responsible for the optical budgets used for each of their specific applications. Where applicable the LFC will provide the Service Provider with facilities to make fibre performance measurements from the MOFDF in the originating LFC Central Office to the nominated terminating LFC Central Office. The LFC will provide staff to access the MOFDF and connect the test equipment to the fibre(s) for such tests by the Service Provider. An additional charge will be made for these services. The Inter-CO Fibre and Fibre Patch Services specifically exclude:
5.3.1 provision or maintenance of any cabling or connection or active device beyond the service demarcation points;
5.3.2 configuration, monitoring, operation, on-going support or maintenance of Service Providers' or End Users applications, equipment or networks; and
5.3.3 supply of AC Mains & UPS Power, accommodation space, heating, ventilating, air conditioning and facilities at the Central Office.
Service Characteristics. Service shall be provided in accordance with Customer’s existing connection requirements unless Customer requests a change by the TDSP and pays for the cost of that change. Customer shall not use the electric power and energy furnished hereunder as an auxiliary and supplement to any other source of power and shall not resell any capacity or energy purchased hereunder.
Service Characteristics. PONFAS is a point-to-multipoint fibre service that provides Service Providers with the ability to provide passive optical network services to a number of Premises, as defined in 4.10.
Service Characteristics a. Service under this Agreement shall be supplied on a firm basis, subject only to availability of supply source and conditions on the electrical, chilled water, steam, or natural gas systems. Service shall not be curtailed or interrupted for economic reasons. Service shall be curtailed or interrupted only when necessary, in conformance with standard utility industry operating and engineering practices, due to loss of supply source and/or delivery system or to preserve the integrity of all or part of regional electrical system or gas facilities and/or the University’s distribution system.
b. Electric Power service hereunder shall be delivered at the characteristics required at the Points of Delivery as identified by the Consumer.
c. Natural gas service shall be delivered at the pressures available to the Points of Delivery as identified by the Consumer.
d. Steam and chilled water service shall be supplied on a firm basis, subject only to availability of supply source and the Seller’s distribution system.
e. The Consumer will pay any and all service charges made for services rendered by the Supplier at the Consumer’s request.
Service Characteristics. (a) Service hereunder shall be alternating current, 3 phase, 4 wire, sixty cycles, 227/480 volts.
(b) The Consumer shall not use the electric power and energy furnished hereunder as an auxiliary or supplement to any other source of power and shall not sell electric power and energy purchased hereunder.
Service Characteristics. 8.1 Service hereunder shall be at alternating current, 3-phase, 4-wire, 60 Hertz, 13.8Y/7.97 kV, 75 MVA with an allowable variation of 10% above or below nominal voltages.
8.2 The City will use its best efforts in good faith to supply continuous electric service at the Facility Delivery Points; provided, however that the foregoing shall not be deemed or construed to be a guarantee of continuity of service. It shall be the responsibility of Coffeyville Resources to install and maintain protective devices, which will protect the Facility’s equipment or process during abnormal service conditions or the failure of part or all of the electric service. The provisions of the latest edition of the National Electrical Code and the National Electric Safety Code shall be considered as the minimum acceptable standard for the protection and safeguarding of persons, wiring and/or equipment of the Facility. In no event will the City be liable for any damages to Coffeyville Resources if the Facility equipment or process is not protected or safeguarded in conformity with such minimum code requirements, nor shall the City be liable for any service interruption, irregularities, or any other causes or abnormalities not caused by the sole negligence of the City.
8.3 In order to make necessary repairs to or replacements in the City’s facilities for supplying electric service, the City reserves the right in accordance with Good Utility Practice, without incurring any liability therefor, to suspend service without notice to Coffeyville Resources for such periods as may be reasonably necessary. When conditions permit an attempt will be made to notify Coffeyville Resources of such an outage. Insofar as is practicable, any interruption shall be made at a time, which will cause least reasonable inconvenience to the Facility.
8.4 The City also reserves the right to discontinue service to the Facility without advance notice, when a defective condition of wiring or equipment at the Facility results, or is likely to result, in danger to life or property or interference with proper service to others. Electric service to the Facility will not be resumed until the defective condition has been remedied to the satisfaction of the City. If such defective condition is the result of tampering with City equipment, the provisions related to the fraudulent use of electricity shall also apply.
