Service Variation. 7.1. Every effort is made to provide diagnostic services as detailed in relevant user information documents such as user guides, service level agreements and technical agreements. However, NHSBT may have to alter the range or specification of services on offer due to technological or scientific advances, or changes in national quality or safety requirements. All changes, which might arise from such circumstances, will be notified in writing to Purchasers or Users in advance.
Service Variation. 11.1.1 Variations in service requirements will be notified to the Contractor(s) as and when required. The period of notice for variations will be subject to individual participating Participating Authority/Participating Authority service criteria.
11.1.2 A mechanism for agreeing variations will be agreed between the Participating Authority(s) and the Contractor(s) prior to the contract award. Contractors are required to provide a proposed mechanism for agreeing variations as part of their submission for NHS SBS consideration.
11.1.3 Please note that the locations/collections frequencies and other details may be subject to change during the contract term. The Participating Authority(s) reserve the right to add or delete sites as appropriate.
Service Variation. 4.1 The Customer may request a variation to the Service during the Subscription Term in order to add additional Content Licences or additional User Licences to the Service. If Standards Australia approves the request, the Customer will be issued with a Revised Sales Order for the Customer's approval.
4.2 If the Customer agrees to a Service variation:
(a) The Customer will be charged the additional amount for the variation as set out in the Revised Sales Order (Customers should note that the pricing for additional content may be different to the original subscription price and will depend on the type of publications); and
(b) The variation payment must be paid in in accordance with the Revised Sales Order.
4.3 The Customer cannot remove or swap Content once added to the Service or reduce the number of User Licences ordered during the Subscription Term.
4.4 As part of the Service, Standards Australia may, from time to time, update the Content by adding revisions or amendments.
4.5 Standards Australia may vary, modify or update the format of the Content or vary, modify, update, or discontinue the Service . Standards Australia will provide notice to the Customer of such update, modification, or discontinuation.
4.6 The Customer may cancel or terminate the Service, if a variation in accordance with clause 4.5 detrimentally affects the Customer’s use of the Service, within 14 days of the variation becoming effective. Standards Australia will refund the Customer on a pro-rata basis any Fees prepaid for any remaining unused Subscription Term calculated at the date of variation.
4.7 If the Service is discontinued, the Customer will be provided with a refund on a pro-rata basis of any Fees prepaid for the remaining unused Subscription Term, calculated at the date of termination.
Service Variation. 5.1 If either Party wishes to vary the scope of the Funded Services (“Variation”), it must issue a written request to the other Party and the other Party must within 5 Business Days (or such other period as agreed) provide a written quote (“Quote”) setting out:
(a) any impacts on the timing of or completion of tasks;
(b) any variation to the funding and payment arrangements; and
(c) any changes to the terms that apply to the performance of the Funded Services.
5.2 The Parties must negotiate in good faith to agree on the price and other terms applicable to the Variation.
5.3 If the Parties agree in writing to the terms of the Variation then:
(a) the NFP must ensure that the Funded Services are performed as varied by the Variation;
(b) the Government Party must pay the varied Block Funding; and

Service Variation. 12.1 If there is any change in the Services, or the manner in which they are required to be performed (including by reason of a change in Legislative Requirements then Lantrak may increase the prices specified in the Agreement immediately by giving written notice to the Customer.
12.2 If the Customer requires the Services to be performed during hours or on days other than those referred to in clause 2 or on public holidays, then Lantrak may increase the prices specified in the Agreement.
12.3 The customer acknowledges that access to the Waste Disposal Facility may be adversely affect by actions Force Majeure, particularly that of inclement weather. The customer indemnifies Lantrak for any loss particular to matters Force Majeure and closer due to inclement weather, or any other matter related to the actions of a third party which result in closer or limited access to the facility.
Service Variation. 2.2.1 Planned changes and additions will be communicated in advance in writing to Merchant and to IPC Europe. Planned changes are covered within the regular Change Management and Release Management.
