Services and Applicable Terms. A. We agree to use commercially reasonable efforts to provide the HR Services as described in your Delivery Order or our applicable catalogs and as included in your PEPM to your designated Account administrators. Upon completion of the initial setup of your Workforce Administration or Workforce Acceleration Bundled Service Package, the HR Services will be available to your Account administrators monthly from the applicable Workforce Administration or Workforce Acceleration Go-Live date and will continue as long as you remain a customer of the Workforce Administration Solution or the Workforce Acceleration Solution. You may optionally purchase additional customized or strategic project-based HR Services (“Strategic HR Services”) to supplement the HR Services included in the Workforce Administration Bundled Service Package. Strategic HR Services may be invoiced separately from your Workforce Administration Bundled Services Package. Except with respect to Account administrators, no support to individual employee Users will be provided. B. Subject to the descriptions in the applicable Delivery Order or any applicable catalogs that we may make available to you to describe the then current HR Services, we may determine the details and means of performing the HR Services provided pursuant to your Delivery Order. We may provide the HR Services by use of phone communications, email, provision of Licensed HR Materials, or other remote means. Support from an Insperity HR Specialist or an Insperity Partner HR Pro will also be provided through the Insperity HR Resource Center. The HR Resource Center Services provided as a part of your Workforce Administration PEPM may not be customized or opted out. C. You will ensure that each of your Users will at all times comply with the Terms of Use of the Insperity HR Resource Center as posted to the website provided to access the online resources, as well as our

Upon completion of the initial setup of your Workforce Administration or Workforce Acceleration Bundled Service Packageand diagnostic review, the Advanced HR Services will be available to your Account administrators you monthly from the applicable Workforce Administration or Workforce Acceleration Go-Live date and will continue as long as a subscription Service until terminated by you remain a customer in accordance with the terms of the Workforce Administration Solution or the Workforce Acceleration Solution. You may optionally purchase additional customized or strategic project-based HR Services (“Strategic HR Services”) to supplement the HR Services included in the Workforce Administration Bundled Service Package. Strategic HR Services may be invoiced separately from your Workforce Administration Bundled Services Package. Except with respect to Account administrators, no support to individual employee Users will be providedthis Agreement.
B. Subject to the descriptions in the applicable Delivery Order or any applicable catalogs that we may make available to you to describe and the online Advanced HR Services catalog describing the then current Advanced HR ServicesServices (“Advanced HR Catalog”), we may determine the details and means of performing the Advanced HR Services provided pursuant to your Delivery Order. We may provide the Advanced HR Services by use of phone communications, email, provision of Licensed HR Materials, or other remote means. Support Onsite support from an Insperity HR Specialist or an Insperity Partner HR Pro will Consultant may also be provided through for certain Advanced HR Services as stated in the Insperity Advanced HR Resource CenterCatalog. The You are entitled to up to ten (10) professional service hours per month for the Advanced HR Resource Center Services provided towards the pre-defined projects recommended after completion of your initial diagnostic as a part of your Workforce Administration PEPM prioritized action plan and selected from our then current Advanced HR Catalog. Projects that require more than ten (10) hours to complete will utilize allocated hours for subsequent consecutive months as needed. If you do not request a project or if there is no ongoing work being performed by us in any given month during your Advanced HR Services subscription, your allocated hours for such month will expire and be considered forfeited. There are no refunds for unused Advanced HR Services hours. The Advanced HR Services may not be customized include leadership and employee engagement projects that allow us to provide assistance with rewards and recognition programs, compensation analysis, and employee surveys; risk awareness projects such as FLSA and unemployment reviews; and HR leadership projects such as organizational chart development, change management and communications planning, and retention and turnover analysis; or opted outother HR consulting projects as recommended by us in the prioritized action plan provided as a result of your initial diagnostic review and setup for the Advanced HR Services, in each case as described in the then current Advanced HR Catalog.
C. Any non- compliance with any provision of the Terms of Use for the Insperity HR Resource Center or the Terms of Use for Cloud-Based Solutions by a User will constitute a breach of this Agreement.
D. We will use our commercially reasonable efforts to make the HR Resource center online resources available 24 hours per day and the Insperity HR Specialists or Insperity Partner HR Pros available from 7:00 a.m. to 7:00 p.m.,Houston, Texas time. We may reasonably specify applicable working hours, as well as hours and times, such as weekends and holidays, when some or all of the HR Services provided by HR Specialists and Insperity Partner HR Pros will not be available. Administrators may call to inquire about the HR Resource Center status updates between 7:00 a.m. to 7:00 p.m., Houston, Texas time. Insperity HR Specialists or Insperity Partner HR Pros will make commercially reasonable efforts to respond to standard HR questions within one (1) business day, to provide initial consultations within two (2)
E. You agree to reasonably cooperate with us and to provide us with information that we reasonably require to perform our obligations under this Agreement. To the extent that you require customized deliverables or additional scope from the HR Services project descriptions provided by us, we will provide the additional fee estimate as a Statement of Work for your approval prior to commencing work.
