Common use of Services Not Exclusive Clause in Contracts

Services Not Exclusive. The services furnished by the Sub-Adviser hereunder are not to be deemed exclusive, and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish similar services to others so long as its services under this Agreement are not impaired thereby. Nothing in this Agreement shall limit or restrict the right of any director, officer or employee of the Sub-Adviser, who may also be a trustee, officer or employee of the Trust, to engage in any other business or to devote his or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or a dissimilar nature.

Nothing in this Agreement shall limit or restrict the right of any director, officer or employee of the Sub-AdviserSubadvisor, who may also be a trustee, officer or employee of the Trust, to engage in any other business or to devote his or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or a dissimilar nature.

The services furnished provided by the Sub-Adviser hereunder pursuant to this Agreement are not to be deemed to be exclusive, and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish similar render investment advisory or other services to others so long as its services under this Agreement are not impaired therebyand to engage in other activities. Nothing in this Agreement shall limit or restrict It is understood and agreed that the right of any directordirectors, officer or employee officers and employees of the Sub-Adviser, who may also be a trustee, officer or employee of the Trust, to engage Adviser are not prohibited from engaging in any other business activity or from rendering services to devote his any other person, or her time and attention in part to the management from serving as partners, managers, trustees, directors, officers or other aspects employees of any other businessfirm or corporation; provided, whether however, that such other services and activities do not, during the term of this Agreement, interfere in a similar nature or a dissimilar naturematerial manner with the Sub-Adviser’s ability to meet its obligations hereunder.

The services furnished by the Secondary Sub-Adviser hereunder are not to be deemed exclusive, exclusive and except as the Sub-Adviser may otherwise agree in writing, the Secondary Sub-Adviser shall be free to furnish similar services to others so long as its services under this Agreement Contract are not impaired thereby. Nothing in this Agreement Contract shall limit or restrict the right of any director, officer or employee of the Secondary Sub-Adviser, who may also be a trusteeTrustee, officer or employee of the TrustPortfolio, to engage in any other business or to devote his or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or a dissimilar nature.

Services Not Exclusive. The services furnished by the Sub-Adviser hereunder are not to be deemed exclusive, exclusive and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish similar services to others so long as its services under this Agreement Contract are not impaired therebythereby or unless otherwise agreed to by the parties hereunder in writing. The services furnished by the Sub-Adviser hereunder are not to be deemed exclusive, and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish similar services to others so long as its services under this Agreement are not impaired thereby. Nothing in this Agreement shall limit or restrict the right of any director, officer or employee of the Sub-Adviser, Adviser who may also be a trustee, officer or employee of the Trust, to engage in any other business or to devote his or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or a dissimilar nature.

Services Not Exclusive. The services furnished by the Sub-Adviser Adviser's services hereunder are not deemed to be deemed exclusive, and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish render similar services to others so long as others. It is understood that persons employed by the Sub-Adviser to assist in the performance of its services under this Agreement are duties hereunder might not impaired therebydevote their full time to such service. Nothing in this Agreement Contract shall limit or restrict the right of any trustee, director, officer or employee of the Sub-Adviser, who may also be a trusteeTrustee, officer or employee of the Trust, to engage in any other business or to devote his or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or a dissimilar nature.
